Default Accident one day after buying car

Well friday of this past weekend was the day I had been waiting for for about a month. The day I receive my new tC Picked it up at the dealership friday then on the following day I was getting my 1500 dollars worth of stereo equipment installed. Get the stuff installed then I make my way over to my girlfriends house.

On the way back (it was raining) I guess I hit a water spot, started hydroplaning then ended up facing the opposite way on the 605 north freeway. Most of the oncoming traffic slow down because they saw me trying to get back around, except for one guy. He hits me about the front left side of the car, which spins me facing the right way on the freeway but in the process shatters my 2 front headlights, ***** the hood to the left damages the radiator, rips the bumper off and for some reason the exhaust fell off.
All the damage seemed to be on the front end and hopefully there was no frame damage. I'll try to post pics soon

I have a question, the CHP came and called a tow truck but they didn't write a report or anything. They said it wasn't required. I was wondering is that something I'll need to give to my insurance company?

I guess the accident could have been alot worse, especially on a raining california freeway facing the wrong way.

yes, that would be a great idea, "Sue... It's The American Way®"

Sue the city for damages that can and will be covered under your insurance company for which they can hold nothing against you that you pay money for their services if you ever need them, which you do.

I mean really - just contact someone high up in your city hall and have it repaired and tell them it's their fault your car was damaged and you have your insurance company backing you up and force them to fix the pothole so it doesn't happen to someone else. Then move on with your life and be glad it wasn't worse and feel good about yourself helping others and preventing damage or harm to someone else.

You can't blame a pothole on driver error. If he had been a better driver and driver more carefully (such as not going so fast that you'd hydroplane), all of this could have been avoided.

What makes you think the city will (or should) pay for your damages? I'm sorry that you damaged your car, but suck it up and file an insurance claim.

The authority that's responsible for the maintenance of the road is responsible for damages caused by defects in the road.

If I live in a different city than The_Juice, but have the same insurance company, why should I end up paying higher insurance premiums just because his city can't fix the roads?

Sorry, I probably should've directed my message to the appropriate person. I really wasn't meaning to rag on you -- just the people who were blaming the city. I really am sorry about your car -- that sucks.

If a city has roads with lots of potholes, it just means that drivers there have to drive more slowly and carefully to be safe. Not everything is a free lunch.

I guess I just see it as a matter of accountability. Making people live up to their responsibilities and do the work you've paid them to do isn't asking for a free lunch.

A pothole on a city street (with low speed limits) is one thing, a pothole on a freeway is another. This isn't a case of a normal feature of the landscape, it's a case of government officials and contractors not doing the job that they're paid to do. If you let them slide, they'll be the ones that end up getting the free lunch.

That makes sense. I was just looking at it in terms of accountability the other way.

The CHP probably didnt file a report because it was a weather related claim. Weather related claims do not count against you as far as your premium goes. It will show up on your insurance report but your insurance wont go up.

They CHP probably knew that it was weather related and that each of your respective insurance companies will deal with it appropriately.
