For New Yorkers ... or the knowledgeable
Last night I was coming home from down the Jersey shore. It was around 1:00am so the roads were completely dead, well sort of (other than myself and the police). I came off the LIE and onto the Northern State because the LIE was closed at 53. I came around the corner and started going faster down Northern State. I knew I was speeding but to honest wasnt really paying attention to how much I was just watching the road and wanting to get home.
Long story short I was pulled over for speeding. Yes, stupid I know. I have never received a ticket or been in an accident in my life so I have a couple of questions. The officer was polite, as was I, but he was talking so fast I didn't understand what the procedural was.
Before you get on me about the speed, don't bother, I have already beaten myself up about it. I am a careful and smart driver, I just made a dumb decision based on the time of night and situation etc.
What do I do at this point? I really would like to avoid having any points against me, and dont mind paying a bigger fine if that was the case. I am really new to this as I have never received a ticket.
Do I lose my license? On the ticket it states "A plea of guilty to this charge is equivalent to a conviction after trail. If you are convicted, not only will you be liable to a penalty, but in addition your license to drive and your certificates of registration are subject to suspension or revocation as prescribed by law".
Any help would be greatly appreciated.

hey man... dont worry so much...
depending on how fast you were going you might just have to pay a fine and get a few points on your license.. if thats not cool with u, you can goto traffic violations court and have your penalty reduced or even thrown out... but if you plan on trying to get it thrown out, you should hire a lawyer.. it will be pricey but they will def. get rid of the poiints...
it also kinda depends on who pulled u over... if it was a state trooper.. that might suck a little more then a regular highways patrol... all in all, if you goto court, you might be able to plead not guilty due to ur current driving record being clean..
but if ur looking for no points, u hbave to plead not guilty.. theyll assign u a court date..

I was going 35 over the speed limit, apparently. Regardless, at this point I am not really sure what to do. If I plead guilty do they then just assign an amount to my ticket and/or points? At which time I just pay it and suck it up? Or do I still go to court?
It was a Nassau Highway Patrol not a Trooper.
If I plead not guilty and they make a court date etc. when I go there, if I choose to represent myself, what do I even say? Sorry, this is my first offense of any kind ... go easy on me?

thats why my radar detector is always on. well over here in TX, if you dont want it showing up on your record, you would have to get a lawyer and pay him to go in and dismiss the ticket. You would have to pay him the ticket fine plus lawyer fees.
The way I used to do it was plead not guilty the first time going in and they reset the court date. on the second time around they talk to you saying if they lower the fee if you plead guilty so as not to go to trial.
I have even talked to some cop friends to talk to the guy who pulled me over. I would go in on the second court date and the judge would call up the cop and he would say that he did not remember the incident and case dismissed. They wouldnt care too much since they get paid time and a half anyways.
and as far as losing your license, i wouldnt worry about it. you would have to be doing more than just speeding to lose it just as long as you wernt going over 100mph
hope this helps - been down this road too many times - i was stupid back in HS

LIE im assuming a state trooper pulled u over? ur gonna get point on ur license unless u fight it but chances r ur gonna get points. 35 over the limit is about 4 or 5 points ur gonna have to get points pay for the ticket and u have to pay a drivers responsibility assesment program, u get this program when and if u have more then 3 points.
do basically if u dont fight or u do fight it and lose in court ur gonna get about
4 or 5 points since it was 35+ over the limit
plus pay watever the fine would be
plus pay the driver assesment program. $125 a year for 3 years or u can jus pay all $375 all at once
i know all this cause same thing happened to me. i got 7 points on my license for unsafe lane changing and speeding but sped 10 over the limit so 3 plus 4 for the unsafe lane changing.
it sux man

There are ways of fighting a speeding ticket but they are not full proof.
One that I see having the best chance is when the radar/cop last certified and calibrated.
If its not within specs, the case gets dropped but they might be able to prove it and once you are in a trial, there is no going back.
safest bet but not the cheapest is to get a lawyer. make sure he has referrals, dont go for the guy who has the best commercial.
some good reading material

oh btw license will not be suspended unless u have 11 points or more so thats basically kinda like a warning depending on if u already have points on ur license.
jus fight it ask if he practiced using the radar and if he has a print out if he doesnt then ull win the case most likely or u can say the reading was for another car if there was cars around u

If this is your first time getting in "trouble with the man" than you might be able to get PBJ (probation befor judgement). What that does is you will not get any points on your licens and will have no fines to pay AS LONG AS YOU DO NOT GET A TICKET FOR THE NEXT 1-2 years. If you get a ticket in that time than you will have to pay the full fine on the ticket and will get the points on your licens. As you said you are a safe driver, and you have gone all of these years without any trouble, if that is true than PBJ might be the way to go.
since u were doing 35 over the limit, i dont think u have an option to plead not guilty... ur gonna have to goto court..
when u get to court, you are going to talk wiht the lawyers there and theyre gonna offer you a reduced offer..
35 over is a 6point moving violation.. theyll probably reduce it to a 3 point moving violation.. anything less than that ur gonna need a lawyer..
honestly, dont plead guilty.. just goto court and tell them you had an upset stomach and was trying to get to a bathrooom... theyre reduce it for u..

yea he probably grabbed you because your an easier target cops usually stay away from people on bikes because if they decide to speed away its a more dangerous situation than him having to chase a car down, i was going to put in some more input about the ticket but rosedale pretty much explained it all for you lol, if anything if you have a friend or family member who is an officer see if they can get in touch with the cop who pulled you over and see if they can talk to them about maybe having it knocked down, if you do know someone have them come with you to court to plead with the cop a bit, i have a cousin who's an officer and i got a ticket for 110 in a 55 (wasn't going that fast but w/e) and a lane violation, i got it dropped to 80 in a 55 and no lane violation, so $350 and 6 points later, here i am it was my first ticket when i was 16 so as of right now i took the class and the points should have come off my record. if anything plead with the cop when your court date comes up, just say it was late you were trying to get home blah blah blah or do what rosedale said and ask for the radar setup but some cops dont like that cuz then your telling them that there wrong which you dont want to do
^^^ forgot all about that one, that one works too
trying to blame it on the motorcycle would be tough since it doesnt have a big signature. it depends on how lose it was to you and what the angles were. lets say if it was between you and the cop then the chances go up.
if it was an 18-wheeler then that would be a different story. those things reflect radar like a mirror.

^^ oh.. uhh.. the class that IceTC took doesnt erase the points from your license... they just make a comment on ur record saying that you took the course and that up to 6 points can be overlooked... but trust me.. the points are still there..
