SengTC3 06-05-2009, 12:16 AM I'm looking to trade my tC for another tC here. I have a quick question about transfer of title. I'm trying to keep the cost minimal as possible. Instead of selling I want to "gift" the car, can I put the value of gift any value, like lets say $0, or Do I have to put like $18k. If it's a gift will it still be taxed? If not, what if me and the other trader both "gift" our cars. Thanks for peeping this thread.

1fastscion 06-05-2009, 12:22 AM If you gift the car you dont have to put a value on it. U just have to pay the title transfer fee which is 15$. You dont get taxed either.

SengTC3 06-05-2009, 12:42 AM Thanks man, thing was frustrating me. I was just comparing it to Christmas. If I give someone a gift I don't tell them how much it's worth and I don't pay taxes cause of it, than why can't it apply to cars?

I'm not sure about that one. I went to the DMV today about my pink slip. The lady said I can just fill out the form for a transfer of duplicate pink slip.
theoneandonly 06-05-2009, 05:01 AM I just found out that if you "gift" a car to someone, the person you give it to will have to pay tax on it. It is viewed as income when it is a gift.

Damn really? I was afraid of something like that. Even if I do it as a sale, they would still have to pay taxes huh?

theoneandonly 06-05-2009, 05:01 PM The way you get around this is when you do the deal, put that you sold it for like $1-whatever amount you want. this way it isn't viewed as income and they will only have to pay for the title transfer and registration.

SengTC3 06-05-2009, 08:18 PM What if I put the sale value at lets sat $2000? just to be somewhat realistic and tell them the engine is blown and car needs repairs due to hydrolock... estimated vaule of repair would be $8.000 and that is why i'm selling at $2000?

Can it work like that, cause i have the transfer title form in front of me, if we do 2 gifts i think they would be suspect and know that it's a trade. In the gift portion it says no individual trade. Will this plan work or will it flop? I did no reread what I wrote sorry for any grammatical mistakes
Trivecta 06-06-2009, 12:16 AM I asked some friends and they told me gifting is free, but one said he had a pay a percentage of the price that was paid for the truck. Is there no way we can just switch titles...without gifting or selling it to each other?

Read it, been doing a lot of research on it too. If you see the Reg 256 statement of fact form there is the option to gift, but...... right next to it says does not include vehicles traded between individuals. If we both do trade than it might be suspicious and is consider government fraud (deep dodo). The only legit way is to have 1 gifted and another buy a car for a low price for lower Use Tax (this is not necessarily illegal) because it is not really a trade... haha. Al of this seems like a big hassle right now, but I don't see any other way around the Use Tax....

about selling the car for 2grand because it needs a motor rebuild, would the DMV then change the title of the car to non-operational or something along those lines?

Yeah but I think it might be too suspect. Gifting the car at different times can cause problems like if im driving a car without the title being under my name and getting into an accident, it would just be a mess.
Thought about the family one too, but my family up north. My dad has a different last name so it is plausible.

SengTC3 06-09-2009, 06:31 PM Hmnnkay I just got off the phone with the DMV... seemed like the guy had an unsure answer. He just said put it as a sell and value at $0 and we shouldn't be taxed on it. I don't know how much I want to trust his word since he did not even know what a scion was.... Also cause he said "I need to go, we've been on the phone for too long", he spent 10 minutes searching up scion tc haha, i ha to give him my plate numbers for him to look it up cause he couldn't find it on kbb. I think I'm going to go in the DMV again haha

SengTC3 06-10-2009, 08:09 PM I just got back from the DMV, the lady spoke really soft and leaned towards me so no one would hear haha. She said put it has a gift and just put the gift value, they'll never know. Haha I don't know what to do anymore. She said if I really wanted the legit way, she gave me a USE tax clearance form and told me to call and ask for exemption. One guy told me it's taxable and hung up on me and I could not get ahold of any other district of the BOE (Board of Equalization).
