Ok so, hypothetical situation.

Say you go out and buy a car. You also do a trade-in, this trade-in has a lien on it.

Weeks pass by, lien is not paid off, dealership seems to have no info on if or when it will happen.

At what point does this become any sort of breach of the 'standard' sales contract?

I know the owner of the new car is also taking this car into another dealer for work on the idle and transmission, so there is a possible lemon law building up....but this issue of paying off the trade has me stumped.

Figured I've seen a number of folks here that work with or at dealerships... so... thoughts?

Well never... Breach of contract would occur if your new vehicle was never given to you, or you never pay for your new car...

The dealership has to pay the payoff amount on your trade in before they can sell it to someone else.
If someone bought your trade in then the dealership did pay it off as they wouldnt have the title otherwise... and you can't sell a car with out a title.

edit: to clarify, technically they can sell it, but they can not register it. So the new owner can't actually drive it on the road...

Can you clarify without the hypothetical part
