Default Arbitration for sunroof, rear hatch creaking defects 10-12-5

I am going through arbitration on Wednesday Oct 12th at 1pm at Performance Toyota Scion in LaVista (Omaha) 126th & I-80. I have had my tC in 7 times and filed for arbitration under the lemon law for NE. There will be a VP from regional office from Kansas City, the Toyota/Scion Service Manager, the arbitrator, myself and one other Scion owner coming already. If you have any these or similar problems with your Scion tC now is your chance for a soap box. Email me back at Tyson1972@aol.com if you are able to attend. If you are not able, email me anyways with what problems you have had along with your name and contact number and I will pass them on. I know some of the problems like the creaking are very common and irritating to us new car owners, so show up with me and let them know. Strength in numbers. Thanks, hope to see you there- Shad Moore

I'm not to familar with what can come of this? What do we gain in this matter? Our TC has been in the shop on and off for close to 3 or 4 months, for the same problem...Sun Roof Rattle. What benefits do you get for taking it through legalities and filing a lemon law?

Good luck.

From what I have remembered in past:

1. sunroof rattle and pop-most are fixed are lubricating runways
2. many different mid to back hatch rattles. Some have been fixed by adjusting metal next to rear dome light. And taping electrical tape to rear latch bar
3. I know there have also been rattles in radio door, side door, vents

Funny thing is, I've had the TSB performed on my sunroof, and it still rattles.

becuz they do the TSB, doesn't mean it will fix the problem. they start with that, cuz MOST issues with the rattle apply to the TSB, but there are more noises than TSB's

im glad ur stepping up and goin to arbitration with this, but the reps/service directors do no like uninvited company..they show up to deal with ur problem, not urs and 5 other ppls...each case is individual, not combined

but good luck though, hope it works out

keep us updated... mine has been in the shop for the sunroof 4 times. They fix and it's ok for a day or 2 and all the popping and creaking comes back.

question:

I have a subwoofer in the back, and even before I got it, I had hatch/sunroof problems. I got it installed by a respected Alpine dealer, yet when I took it to Toyota, they told me the rattles were due to the subwoofer (even though the subwoofer was off and I had the radio face taken out of the car, no way they could test it) they refused to do anything. I still have the hatch and roof rattles, radio door rattle (im about to just take it out since they won't touch it due to my aftermarket radio). Im 9 hours away from my car till November, but id still like to start filing stuff if I must since I am displeased at the quality of my car at only a little over 10,000 miles and the lack of effort put in by the Toyota Service Center(s).

I filed for arbitratoin about 7 months ago, for the same problems, mainly the sunroof. Local dealer could not fix, nor could the regional tech person that visits the different shops. It was in about 4 times with no luck. Any ways, the arbitrator did not feel that my case was enough of a reason to vote in my favor. I wasn't expecting them too. I have learned to live with the problem, and will get around to fixing it myself when I finish up some of the other projects in my garage. I should have just fixed it myself the first time, but this is the first new car I have bought and thought they shouold have on principle. Anyhow Good luck with your case.

Iteresting as to why STMoore's name is on my quote... Anyhow, so you still get to keep your car if you win the arbitration? And you can get a cas settlement? Interesting, I thought you had to give your car up if they were going to give you money. I will look into this.

Thats what my laywer said about what they can do night be different in arbitration since you are on your own with no council

By the way I never replied or asked that by how the previous post looks. My only post was the first initial one. Anyway, he heard the creaking noises and the wind noise. They will notify me within 10 days of the arbitrators decision. Probably be something along the line of having Toyota buy back the vehicle but who knows. But then I am back to square one, so good and bad. I will let you all know how it goes. Thank you for all of you who emailed your own concerns and Oscar for coming.
