Default Stolen Picture!

So I was just going through eBay and I saw a familiar picture. The person was selling a front lip and he was using my pic on his eBay page. If I report it, will he/she have to take it off?

Well unless you copyright it, he can technically use it. Now if he is a good seller, he should remove it at your request, but he is not under any obligation to. If you had markings on the image then it'd show its yours.

However there is also the fact that he took your picture, modified it by putting his ebay username ghosted onto it, and posting it (basically claiming it as his own).

A guy on SL (boiseauctioneer) used a picture I took of my TYC tails I was selling to sell his on eBay. I would have been cool if he asked, but he didnt. I reported it and they didn't do anything though.

There is nothing you technically have to do to copyright something. We had to go to a meeting about this with our intellectual property attorneys about a year ago. For example, if you write something, it is copyrighted immediately. You own it if you want to enforce it. You can get a copyright registered, but just because you dont does not give someone else rights to use or copy it.

For pics, however, it may be more tricky, especially if you posted it online first.

If you provide eBay with the original pics, before he put watermarks, they will remove his entire auction.

that's not cool.. though i have had a few of my pics being used for other things..

my guess then is whoever typically uses such pictures online.. sometimes doesn't know where they came from or who they belong to..

so.. hmm.. i don't see why a company can't just take pictures of their own product..

Yeah that sucks, mine's still on ebay too, haven't received a cent. I asked the seller to stop or to at least hook me up with an oil cap or something, he just said it should be a compliment. and he's still selling that dumb grille, THAT I DON'T EVEN HAVE! Anyways, I reported it to eBay but they did nothing...good luck with your situation.

You don't have to have it watermarked for it to be illegal. The only way they can legally use a picture of your car is if they took the picture themselves on public roads. And then they need to state they aren't selling the product on that exact car.

I have gone through this dozens of times, LITERALLY!! My picture is all over web sites and eBay. I have contacted sellers and eBay and Companies,. and nothing has ever happened. Its a worthless cause!!

yea my picture of my car is being used on the "replacement carbon fiber hatch handle" auction but mine isnt what he is selling, mines just an overlay piece, he is giving me a discount if i ever wanted to buy his for using my pic

man i would consider it an honor to have my trash posted on ebay... to me it just means out of all the other people to take a pic from and use to sell things with ..he chose mine.... think positive about it... he could of totally used your pic on another website and said your car was his...
