Should I give it back?

Default Should I give it back?

06 scion tc 5 speed... first week intake manifold studs were stripped so it was leaking coolant plus the vvti gear assembly was jammed.. warranty covered it... loaner for a week... then got the car back... car was leaking oil now... From between the block and the head. Car was bought in NY from a dealer. I am not sure I want this car anymore...

In a loaner now, they will be calling me on Monday with diagnosis.

I believe NY lemon law is on my side.. though I need to do research. Should I call it quits on this car and try to get my money back/another car? I picked up the car because of a low used price... dunno what to do

Give it back. Without a question. It's a lemon. All these problems within a few weeks of owning it? It doesn't seem like a reliable car.

2 trips isn't an unreasonable amount of trips for repair either. While it may suck, your car does not fall under lemon law. The first time you took it the studs being stripped sounded like it was from someone, likely previous owner messing with it? VVTI cam gears could have been a fluke. The leaking oil is likely from a bad gasket when they did the reinstall. Lemon law does not cover the dealership making a mistake in the repair, and likely the dealer will call and tell you they are fixing their mess up on the house.

Simply, unless it KEEPS having problems, and generally they have to be a repeat of the same problem multiple times that a dealer cannot fix, you do not qualify for lemon law. When I was at Chevy, it took 7 trips for the customer to push for lemon law, and even so it took 4 different Chevy Engineers coming to fix it, and they still didn't get lemon law.

How long (total) have you had the car? i don't think you fall under lemon yet but the dealer may still work with you to find you another car.

If it were me I would fight like hell to return it.

Yea.. I don't think Lemon law helps in this case. I have to just grind it out. I will talk to the dealer and see if they would be willing to get another car or try to work something else out..

I think this is a bit ridiculous though. of about 5-6 weeks of ownership, it looks like 2 weeks are going to spent in a loaner... not to mention getting the car towed to the dealership the first time and leaving work early or taking late lunches to get things done..

I dunno man. I have already dismissed the idea of enjoying this car to the point of modding it. This month of ownership has already taken the wind out of my enthusiasm sails. I feel like I should have just bought a old automatic corolla.

The deal with a dealership is that they are not going to agree to work with you. Don't go in there and "ask" for them to work with you. "demand" it and tell them that you are not happy. You either want the car for cheaper since it is obviously not the car you/ or they thought it was and is no longer in the condition it was supposed to be in. If you are adamant enough and talk right you could almost return the car. I've had friends that have dealt with this kind of thing before and one of them ended up with his money back and went to another dealer to buy his new car. Do not think that is common though and he faught like crazy to get that deal but it is "possible" i guess.

To be honest you could always play the card that you have technically only owned (had possession) of the car for 3 weeks and it is a POS. Now after they fix everything and if it's still under warranty it may end up being a reliable car just an unhappy start where this should be the most fun time of ownership.

as long as it is under warranty and this keeps happing you could also fight to just replace the entire motor if nothing else will fix it. But by that point you may fall under the lemon law.

Good luck man and hopefully you get whatever will end up making you happy.
