Default Cold Air Intake / Sway Bar issue

So my xB I just bought a bit ago has a cold air intake & sway bar...problem is that the pipe on the cold air intake rattles against the sway bar above it. I think it is suppose to be partially anchored down by the battery.
I had the pipe zip tied to the sway bar for sometime but has since came off. Anyone have any ideas that won't cost me a fortune? Any input would be great....here's a couple of pics....





This is a pic of the anchor on the battery..the metal rod doesn't go anywhere @ the bottom it just sticks out

Cut off the small section of the intake so it sits a little lower.
And it's the strut bar you are referring to, not sway bar.
