Default "fatkid" alarm issue

long story short, "Fatkid" was selling a scion security system for 50.00. I asked him if it would work with my 05 (knowing there was a model for 06+ w/steering controls)
I sent him this message:

From: Archngl
To: Fatkid
Posted: 9/28/08 8:08AM
Subject: Re: alarm
As long as you're positive it will work with my 05 (no steering wheel controls), and everything is included, I'm down.

-paypal ready.

his reply:

From: Fatkid
To: Archngl
Posted: 9/26/08 7:36PM
Subject: alarm
the alarm will work with the 05 as well....thats what i have..

I paid for the item, and received the model that does not work w/my car.

I notified him of the problem, he replied with:

From: Fatkid
To: Archngl
Posted: 10/6/08 4:55PM
Subject: Re: alarm
i added this same alarm to my 05 xb....and i did blow a fuse so i talked to a toyota tech and he showed me how they install it and since then i have never had a problem.....if you would like i can have him send you the diagram he used.....im a pretty easy going guy tho so if there is something else i can do just ask.

after a few months of no instructions, I asked for a refund, and got this response:

From: Fatkid
To: Archngl
Posted: 12/27/08 9:20PM
Subject: Re: alarm
sorry guy...no refunds...i have refused to work with you because i tried and you acted like a jerk....plus i have you on message saying that you would take it regaurdless....no refund.....not to mention the fact that you got a 400 dollar item for 50 bucks....had you not been such a jerk i would have been more than happy refund you your money...so you can do what you must but i will not be contacting you anymore and i will not read messages from your username any more.....you can try what you will to get the money back but i will be reporting to paypal the situation along with dated messages between the two of us....me saying it would work and you saying you would take it regaurdless....thanks for the long lesson in how things work on this site.

the message he is referring to was this message I sent to him clarifying to him the difference between the two models of alarms:

From: Archngl
To: Fatkid
Posted: 9/28/08 9:02PM
Subject: Re: alarm
I can send/fax you a ups label so shipping's covered.

and yes, there are 2 different models for the scion security. One works with all, ans one workd only with the XBs w/steering wheel controls...

But regardless, I'll take it for 50.

I was using "regardless" like "anyway". Not "I'll take the item regardless".

So any input on what a "jerk" like I should do?

FATKID: 10/20/08 1:53PM

take it all apart and take pictures...until i hear from him thats all i can do for now

ARCHNGL: 10/20/08 2:09PM
I understand, but I'm sure you can understand my impatience. I've paid for an item that I was told "wold

work", only to receive an item that I've been told countless times "doesn't work". But out there

somewhere is a modification to MAKE it work... and I don't have it.

You'd be impatient as well.

-ken

FATKID: 10/20/08 2:12PM
i do understand very much but you did also tell me you would take the item regaurdless....i kept the

message....however im not a dick like a lot of people on here so i wouldnt leave a fellow scion owner in

the cold.

ARCHGNL: 10/20/08 2:28PM
I kept them too.

Been 16 days since our last conversation. Just checking in.

ARCHNGL: 11/25/08 2:25PM
hey bud.
Still no info on how to make that alarm work.

-Ken

ARCHNGL: 12/2/08 8:34AM
my birthday's comin' up this friday, and I can't think of anything else I'd want besides making that

security system work.

-ken

ARCHNGL: 12/9/08 10:18AM
Am I screwed out of 50 bux at this point?

I went to my dealer and they told me that it could not be installed on my 05.

-Ken

ARCHNGL: 12/26/08 6:46PM
Since I can't get this item installed, I'd like a refund. As soon as I get the funds I will mail the item

back to you.

-ken

FATKID: 12/27/08 9:20PM
sorry guy...no refunds...i have refused to work with you because i tried and you acted like a jerk....plus i have you on message saying that you would take it regaurdless....no refund.....not to mention the fact that you got a 400 dollar item for 50 bucks....had you not been such a jerk i would have been more than happy refund you your money...so you can do what you must but i will not be contacting you anymore and i will not read messages from your username any more.....you can try what you will to get the money back but i will be reporting to paypal the situation along with dated messages between the two of us....me saying it would work and you saying you would take it regaurdless....thanks for the long lesson in how things work on this site.

If the item will work with my car... I just want to know how. That's all I want at this point. If he can't produce that... a Refund would suffice.

i gotta go with ken on this one. he asked if it would work on his xb and his answer was yes. this was the 1st mistake. had it been no, the sale would not have happened.
trying to make the alarm work was a good move but matt failed to deliver. i dont see how ken acted like a jerk by sending you messages asking for help. its not like he messaged you everyday. it also looks like you went back on your word: "however im not a dick like a lot of people on here so i wouldnt leave a fellow scion owner in the cold."

i doubt that you will get anything from paypal, i know i didnt when i got ripped off by someone on ebay, but you can always try. you can always sell it, just make sure that you answer any questions truthfully and not drop the ball.

Unfortunately, When you said that you would take the item regardless, that was implied that you would take it wether it was the kit for either vehicle.

I feel your pain, but I think your stuck with it bro.

If you look back to the posts, he assured me it would work, THEN I said I would take it.

The message with the word "regardless" in it is after him assuring me the item would work with my car. And in that message,I was clarifying the difference between the 2 models, then used the word "regardless" to get back to the issue at hand. In context, I was saying "anyway". Out of context, It looks like I agreed to take it even tho I couldn't use it.

Read the posts front to back, and you'll see my point. the proof is in the pudding.

regardless, what I'm really looking for is those installation diagrams he promised me 2 months ago. If it will work, let me make it work!

OH I read all the posts. I still think you had the wrong choice of words, and unfortunately I believe it will cost you the loss of your $50. I had a few people at the shop here read through and they all said the same thing... Regardless of you asking if it would work, as soon as you said you would take it regardless, it looks like you implied you wanted it no matter what kit it was.

^even if it can be misconstrued that way, aren't I at LEAST owed the schematics that he promised me?

Well he didnt really promise them to you. He said he would have a tech friend of his contact you with them. So he pretty much left it with that.

He should just give you your $50 bucks back and call it a day. Just be a stand up guy, realize that there was a misunderstanding and take care of it.
