Default Driver kills dog, then sues owners for damage

http://www.msnbc.msn.com/id/24530214/

A Civic driver kills a miniature pinscher and sues owner for $1100 plus court fee.

Even it is the dog's fault, I could not find it in my heart to sue the dog owner.

"Ely said he feels sorry for the Munthes' loss but, as a dog owner himself, feels that they must be responsible for their pets' actions."

I agree.

Sorry pet lovers, but it's your responsibility to keep your pets out of the street.

I hit a cat that ran into the street once. It did some serious damage to my box. The owner chased me down to cuss me out, and I felt the same way as this guy. Like, hey, you're lucky I'm not suing you for the damage to my car!

I know some people will call it a push, a lost pet for a damaged car, but some people have too many pets (unleashed or unfenced) near a busy street. They should be responsible if they run into traffic.

"a miniature pinscher, squeezed past owner Nikki Munthe as she was letting in her other dog and ran out onto the road."

How many pets does she have out in the streets?

People need to control their pets....so I think this guy is totally right in this case.

I dont think I would sue tho, losing a pet is hard enough.

I mean to be completely honest if there is a leash law they are responsible of their pets at all time and must be in control...How would you feel if you had to shell out your insurance deductable for someone not controlling their animal...

It is sad that it happened dont get me wrong but if it where me that hit someones dog and messed up my car damn sure i would ____ed off

If I wasn't speeding and wasn't doing anything wrong, I'd have the guy pay for the car. its your pet, its your responsibility.

Isn't it the law that the owner has to have full control of their pets at all times?

I think I would've made the owner pay for damages too...

And this isn't one of those cases. I'm pretty sure she refused to take care of what clearly is her responsibility and the driver did what they felt they needed to do to get compensated.

The owner of the pet is responsible for the damages to the vehicle. She failed to maintain control of her pet and her dog caused damage to some ones property. And what amazes me is the dumb _____ filed a counter suit!

If I was the driver I would have just filed a claim with my insurance company, paid my comprehensive deductible (a claim like this wouldn't raise your rates) and let them deal with her to get reimbursed for the damages her dog caused.
