Please excuse the profanity as well.. this is his story of what happened that morning... by the way, we're thinking about taking this to a small claims court to sue either bob's towing or walnut sherriff station.. thanks


"So last night i was really sick, i caught a BADDASS fever. I woke up, I heard like a sound like a trash truck outside my house, but its not trash day. I look outside the window and see a cop witha tow truck, and my gold fc3s on it. I hurried and put my clothes on, and ran downstairs, and said HEYYYYYYY, STOPPPP!!! the tow truck drove off, and the cop SAW me, looked at me and PEELED OFFF AWAY.... CAn u believe this? I chased the tow truck driver down with my gfs corola, to the tow truck place, called bobs towing, and was like WTF man, why the hell did you guys tow my car? The brotha tow man said the Walnut sheriff station ordered them to tow it, and I SAID WTH did I do WRONG? its parked on my street next to the curb with no signs and Im just sleeping. The tow truck driver said, the officer thought my car was abandoned. Because the license plate is registered under my other house that caught on fire a few months ago, and my insurance company relocated us to this new home. So I guess when the cop ran the plates, it was suposedly registered at my other house that is still under construction, so he towed it. I WAS ____ED. The tow truck company couldnt help me, so i called the sheriff station, and they said they dont know anything about it, yet maybe the paper is not processed. and hes telling me to calm down and all, and IM LIKE WTF u guys towed my car, and IM SICK WITH A FEVER, I could barely drive im so ____en dizzy and cold and hot and sweating. So I drive down to the sherfis station with my gfs corrola with barely any GAS, its on E and im dying because imreally sick... Got there and spoke to the cop that peeled off from my house. He said he thought it was abandoned, and when he looked inside itwas all gutted, so he thought the car was stolen, and one of my neighbors reported it abandoned. But its BS, because I DRIVE my FC3s EVERY dayy. I told the cop that, and he says well sorry there nothing i can do. I asked him then why did u peel off away when I yelled at you to stop? He says he thought I was a kid waving hi from far away. WTF bSSS. I GOt reall heattedd...So I said This is BULL ____. STRAIGHT UP. Im sick and ihave todeal with this crap..so "if I go to afriends house visiting in broad daylight, and my car is not registered to the addres ur guna tow it?" He stuutered and said noo....but if we get a complaint, we have to do something. I said why didnt u guys at lease knock on my door, u know wtf. he says he wasnt sure which house. I know hes just being a dick.. and he said okay il see what ican do, and he ran the papers or something and checked my ID and came back and said to me, IM sorry but your car had oil leaking, and it is a major road hazard, even if its not a abandoned veicle i would have towed it anyways,. IWAS LIKE WTF, all cars leak oil. Your just changing the reasoning! SO he told me to go to bob towing and pay the towing fee to get it out, and I said dont I need a release form, and he said no. So i drove all theway to bobstowing,and ended up with the fat lady saying u need a release form, so I had to driveall thewayyy back to the sherfifs place, and they said i have to pay $93 for release form, and the towing fees. I said dood, i didnt do anything wrong, I should not have to pay. Im a student, i have no job,and no money what do you want me to do???? he says, I dont know what to tell you man, shiet happens." He says do you want me to get the watch commander to talk to you, hes guna say the same thing. I got so heated.. I wanted to turn into virginia tech status on those cops. seriously...man i pay taxes and shiz, my car is registered insured , I daily it, I drive VERY calm, and I always help ppl that break down on the road in my fc[i carry all my tools], like wtf man. discrimination . seriously.
I have no money to get my car out today, so tnite i asked my dad for money, and he got hella mad, he says I just need to get rid of my rx7. He says society just hates my car. I said man this is America, its like myfc3s is colored and I cant even freaken park on a legal parking street in front of my own home? Its like my rx7 doesnt belong on the street. Its street legal, it has stock exhaust, stock s4 na motor, emissions... Its quiet as hell.. In america u should be able to drive whatever youwant as long as your not causing chaos or noise poluution... Im tired of getting hassled by cops because the way my car looks.. its BS/// If I decide to sue walnut police, its not even guna be worth it because of how much money I have to spend on the lawyer, and its not justify..

SO what do guys think? Am i supose to pay all that money to get mycar back or fight for it back with paying anything? Where do I go 2 complain about this? Because its a mistake the police made. My car is not abandoned like they thought it was and they towed it.. I daily my fc. its registered up to date.

Oh yeah when they towed it, they ripped off my bumper cuz itwas too low, and they yanked off the turn signal wires just like that. wtf... is going on with this world... im still sick.. taking airborn"

 

get an Attorney or rep yourself in court, sounds like a good case to win...sue them for agrevation, time out of work, new front bumper and paint, tow fees and gas money.

If I understand a few of the statements made:
#1. The vehicle is legally registered.
#2. The vehicle was legally parked.
#3. The officer checked the registration, which came back to another address; but not as a stolen vehicle (there goes that excuse).

I could be wrong about this, but I thought it was California law that following the suspicion or public reporting of an abandoned vehicle, the police are required to post a notice (usually a yellow or orange sticker) on the vehicle notifying the owner that they have 72 hours to move the vehicle or it will be towed at the owners expense. This provision is specifically in place to prevent the accidental towing of a vehicle that is not abandoned. If the police can prove that an abandonment notice had been placed on the car, then your friend's out of luck.

In regard to towing a vehicle because it is not located in front of the owners address; if that were the law, then we wouldn't need cars because it wouldn't be legal to park them anywhere but home. It just doesn't make sense when you talk it through.

further updates is that, the tower had a heart attack the same day the car was towed... the cop had changed their story from abandoned vehicle to a road hazard for an oil leak. -_- dumbasses.. the towing company also said that scratches and such were already on the car. there weren't any, until the towed it. which is why we are leaving the car there for further investigation.. (the car is paid off already though, ready to be picked up. just left there for investigating)

The owner needs to get ALL the paperwork ASAP! and take this to small claims TOMORROW!

UPDATE 8/21/2008 3:30 arrived..

We went to BOB's towing today at 3:30pm. So ultimately, we have to take it up with the walnut sherriff station.. Evidently, bob towing just works for the police and bobs towing just acts like their _____.. they do as they're told..

Holy ____! That's some ____ed up ____. Take all your evidence and get an attorney and take that to court! That is some serious BS right there!

 

You could always threaten to get the media involved. That is cheap.

 

lol.. he's already written letters to abc.. hopefully, they will get his story on air because apparently, this has happened to other people as well.

 

civil suit..an officer when they act outside of the law has no protection..attatch his performance bond and that will make him unbondable/out of the biz.....
