SAN ANTONIO -- A pair of Somerset High School students were racing in excess of 100 mph on a south Bexar County highway when one of their vehicles crashed into a pickup, killing an elderly man, prosecutors said Wednesday during opening arguments of the teens' trial.

"The evidence we will be presenting to you will show that these two defendants decided that that Friday afternoon they were going to take charge of Highway 16," Lisa Rodriguez, a prosecutor, told jurors.

Jonathan Pena and Gary Garcia are on trial for the death of 71-year-old Felipe Rodriguez.

Prosecutors contend that Pena and Garcia were weaving in and out of traffic on Feb. 20 before Pena crashed into Rodriguez's pickup.

The victim was ejected from his vehicle and died at the scene.

But defense attorneys claimed that Rodriguez is to blame for the crash. They claim that the victim was legally drunk and was driving too slow. Defense lawyers also deny their clients were racing.

Pena is charged with manslaughter and Garcia is charged with highway racing death.

Then to make it worse - it was the dead drivers fault for NOT GOING FAST ENOUGH.

This is why I want a sticker on the back of my car...

"Not for Street Racing Use, For More Information, See me at the Track This Weekend"

Maybe it will stop every riced-out honda in the world from trying to race me at every single encounter on the road.... ugh...

I agree with you on that... But however I highly doubt it will stop EVERY riced -out honda or what have you. Morons will be morons be it on the track or in the streets.. If theres 1 stupid Ahole who wants to race in the street quarantee theres another. I commend you idea if we all could do something like that perhaps eventually street racing will cease.

I had a friend (we no longer talk) he had a fully worked '91 mustang gt chose to sell it. He sold it to a kid in his late teens or real early 20s the kid took the car out 1 night on a local strip of highway by our houses raced some other kid. The driver of the stang lost control and killed himself along with the other racer.. I just thought I'd share the story. But like I said theres always some kid who is too eager to race someone and can't wait til the weekend to take it too the track..

I hear ya. I had a sad looking and sounding dodge try to race me the other day, all revving his hole-filled exhaust sounding engine at me. All I could do was shake my head. It actually felt good to do that too. make him feel like a moron.

Another example of two people who I like to call wastes of food. It is too bad 'eye-for-an-eye' is no longer in fashion, because these two tards deserve everything they'll get and more.

Street racing is sooo lame...it's all about ripping it up on the backroads and track days...especially track days...that's what there for. Too bad some people don't realize that.

^Nice!! For some insane reason I don't get HonDUHS and rice mobiles wanting to race me. I get HonDAS with like b16-18 swaps, STIs, Evos, and even a Porsche wanting to race me...I'm quite dumbfounded really...I mean yeah I have an exhuast and I do have an Option sticker above it at the universal Option sticker above exhaust position, but still....Maybe I should just get a plate frame that says "I pack 116hp...at the crank"

Maybe he could sell a few, if it was the right design, I would so be on top of it....

for real peeps are dumb..i was following a 96 mustang with my gf and 2 kids and homie was on the phone yap it up going like 10 miles ..i was like wtf so i go to pass him and what does he do revs at me and try's to race me ...iall i wante dto do is get around your dumb ****..i was gonna pull next to him and ask if he wanted to race my bro's ss and not my slow ___ box but said f it ....hed mostly likely cry about it cuzz most stang owners wont race camaros or at least not here in cali..
