Default my poor car :-( *pictures added*

yesterday during one of Wilmington's random t-storms, a random gust of wind pushed over a 10 Ft A frame ladder on the side of the roof, then slid on the side of the car and slightly creased the rear 1/4 panel. now keep in mind this ladder was set up all freaking day next to my car with no problem. I clock out for lunch, go to BK and parked in the same exact spot where the ladder was. While im chowing down on my tenders and coke float, i hear a thud and a scrape. i look to see in slow motion the ladder sliding on my rr antenna window and then on the ground.

if i was clocked in, i would have been fine. but since i was clocked out for lunch, nobody is responsible

i cannot go through insurance so i have to go all out cash.

so im looking for a good body shop also willing to pull out a few dings and dents here and there, as well as repair the paint chips and scratches up front for a good value.

so........ help please :-( my other baby is hurt. and the other one as we speak, just spit up on me.

that sounds like a load of crap, how is it nobody's fault? whose ladder was it? they are responsible. and why can't you go through insurance? did you get liability only or something?

That really sucks. But, regardless of you being on lunch, it should be the companies responsibility to pay for it.

your boss is full of crap.

he is telling you that if this had happened before or after your lunch break, that he would have been responsible, but since it happened in this 30 minute window it isn't his responsibility?

smells like bull $h!t to me.

that ladder, which is property of your company damaged your property while it was on site. you have suffered damages because of circumstances you are not liable for.

tell him to agree to pay for the damages, or pay your deductible (your rates go up for accidents that are your fault, not for comprehensive random ish that can happen to anybody). your car being legally parted at your job during normal business hours getting damaged is not something they can jack up your rates for.

if you pay for this, your a chump.

That should be covered under the business umbrella liability insurance. I'd raise hell, they are responsible...although you may have to sue to prove it.
