It depends on the State that you are in and what type of inspection and emission test they do .
If they do no visible inspection on the emissions system you would pass that. This is probably the hardest to pass because it is very easy to see that it is not a stock header.
Which moves you into the next round of the actual emission test:
If they do a sniffer test on your car, (Hooking up to your tail pipe) I can't say, you may pass you may not. Seeing as you will be removing the main CAT on your car I doubt you will pass.
However, if your state does the OBD2 port check for the emissions test, And you have no CEL (Check Engine Light) on, then you should pass. Big plus on WR is that they give you the CEL fix for the 2nd O2 sensor to turn off the CEL.
If your state has the sniffer test, then most people move on to the idea of getting a High Flow Universal CAT. But there is no guarantee that this will be efficient enough to make you pass.
But here is what you need to look at, the fact that this header, and all headers for the tC in fact, are "Off Road Use Only."
What ever you do, don't get rid of the OEM header. If you do get caught you will need to put it back on.
And I leaned all of this info from Scion Life. So I know that this information is available. You could probably read for a whole week and still not get through all information/threads on headers on the tC.
