Default Damage while trying to avoid an accident

today i was driving on the right line. a van on my left hand side cut into my line (i was on her blind spot). so i press the horn and move to the right in order to avoid the contact. however, i end up hitting the curb at 40mph and my front right rim is messed up.

i love my stock rims so much...
so can i ask the driver of the van to paid for the damage?

how does the insurance company handle these kind of situations?

is there any chance that i can have her insurance company to paid for the damage?

Your SOL.
Your insurance company will hike up your rate because they will consider it your fault. If you choose to claim it.

For the price of the rim, the insurance wont give you anything because of your deductible. Unless you have like a $50 deductible, it isnt worth trying to claim.

x2. not worth it and you wont be able to claim crap since its only rim damage and rims are cheap. Look in the classified. People are selling all 4 for $150.

your better of looking in the FS section or on ebay.. I ended up getting a replacment well off of ebay for about 40 bucks shipped. or take this a change to get some nicer aftermarket wheels and tires..
