My brand new Scion tC... just got the plates on today. 3 weeks old, was hit by a car behind me when stopped. A FORD SUV DIDNT BRAKE hit the car behind me which then hit me. I pulled over police came...

Exchange info, but now I want to know if Scion Toyota covers the damage through warrant cus i bought it weeks ago?!

damm you have a silver tc and your in seattle too !!!

anyways, in your situation, your fine. you didnt hit anyone in front so your not at blame. It was the person who hit you's fault. their insurance should pay for your damage. As for toyota fixing it, you can decide who you wanna go to to fix your car and get quotes (i.e. toyota if they have a collision center) or the insurance company will refer you to one of their repair shops.

relax. just make sure that if it takes longer than a day to repair, get a loaner car so you can drive around (if its free).

the guy with the Ford Suv is responsible for the repairs and damages..I got rear ended before too so I know how you feel. Lots of headache with going to court and what not but yea if you car is pretty much deemed total....then you should get a new car by his insurance. If your car has no frame damage then his insurance should pay for repairs.

I don't know the law for Washington but in NC if a car gets hit and it makes them hit another car, its their responsibility for the car they hit, it goes along with following too closely, even though they were stopped, they were sitting too close to you in traffic which makes it their fault.

There is an exception to that in NC, where there are cases of reckless driving. If someone cuts across lanes of traffic and someone hits that person in the rear because of it and that person hits another vehicle in front of him his insurance pays for all damages incurred due to his reckless and negligent driving. 90% of the time when you hit someone in the back that person pays but there are exceptions to the rule.

has to be the biggest FAIL i have read in a while. go through your insurance and let them recover all the information about the accident. give them the report number and they will take care of it. it won't raise your rates since you were not at fault. you can also contact the insurance of the vehicles that were involved.

Yeah, you can read you warranty to see what it covers. This is definitely not.
But this is why you and other drivers have insurance.

Thanks! I went to court because my insurance hasn't came to me because i just put insurance on it when i bought the tC and it is mailing to me... and the cop told me i get a 550$ ticket so i have to go to court to show proof of my insurance, i got it e-mailed to me to print right now, it does suck! i called toyota and they said get a de-appreciation check... like car fax with kellys blue book and grab that extra thousand...

It really sucks, i need to go to the TOYOTA body store to get official Scion parts and legit Toyota mechanics.

Thank you all.. but does anyone know how i can get money from the time lossed of work, insurance claims, gas, driving to the court which is an hour away, back forth missing school, etc.
