Default so i got in an accident and this is BS

im at a red light downtown the other day, and some _______ in front of me decides to reverse from 8 feet in front of me right into me.
ii could not back up because of cars behind me, so i just honk my horn and pray.
He gets out of his car and says he did not see me....ok....how do you not see me.
his excuse is that the person in front of him was trying to parallel park so he backed up to give them room, but there was nobody in front of him, we were at a red light.


anyways, the dude messed up my entire front bumper, cracked it, paint chipped, grille is busted, and the force of the hit broke the bumper clips, and cracked the splash guards under the wheel well.
the dude was goin like 15mph in reverse when he hit me.

i call geico (his insurance company) and go through all this bull____ and then i get a call yesterday the other day and they tell me that they are going to cover all the damages done to my vehicle.

i go to one of their insurance claimers this morning to get an estimate, and the guy tells me he cant even give me one because i told him i will not be getting work done to my car at the dealership.
I want to go to a body shop where a friend of mine works so it can get done right.
i tell the guy i want the entire car re painted and a new bumber because its a brand new car and i do not want the paint just patched in, because everyone knows you can see the blends at certain light and angles.
In any even the guy gives me a hard time and said i will not have to get the whole car painted. although, i insist.

i told him when i wanted to get my door dent fixed 3 monthss ago i went to the dealer and they told me they would have to paint the entire car because of the same reasons listed above, but wait, that was when i was gonna pay out of my pocket


So, im talking to the guy and i explain to him that my car is limited edition release series with limited edition paint and he says "geico does not cover any aftermarket parts, unless they are covered with your insurance ageny."
really. did you not hear what i said.
i told him that it came stock from the factory and his responce is "scion never put out ANY limited edition vehicles, i have to look into that"
So of course im getting ____ed off at this point and i tell the dude i want a new bumper,grille,bottom grille, wheel well covers and my whole car painted.

he says " oh, we can just patch that up."
No. its a brand new car, i want a new bumper.and i want my damn car painted right
All in all, the conversation continues until i just lose it.
i tell the guy im going to kick the ____ out of him and i start yelling making a scene(on purpose), so i get kicked out of the dealership. I called geico and told them what happened and now i have another appointment, with a different guy on monday.
lets see what happens\\.

A) Geico sucks.
B) The "paint the whole car" thing would be up to the shop. Even if you insist, they are not obligated to do that - unless you're shelling out the extra $$ for it.
C) Geico sucks (let him look into the whole RS thing, he'll be edumacated).
D) You can't tell them what you want fixed and expect it to be done. They do an estimate (which means nothing if it is just the Geico person doing it) then you go to a shop and they say what needs to be fixed. If anything you then work with the shop if something is not to your liking.

i agree with all of what ack said, you can't tell them to paint the whole car and expect it because it's only your front bumper that got damaged but what you can do is before you get your car back from getting fixed you have to inspect it and make sure there is no orange peel, everything is in tact, paint matches 95% perfect as it will never be 100% perfect again. because if you find things wrong with the car you have to tell the shop what exactly is wrong before you drive off with the car, you can't drive off and a month later go back complaining that something was wrong or missing. you should really keep your cool and watch what you say because if things go crazy and you make threats then they can go after you for that. also you should have geico's adjuster and your insurance adjuster both take a look at the car before anything is done to it that way geico doesn't try to screw you over on knock off oem parts...one more thing, if you take your car to your friends shop and they repaint it then they gotta becareful because that would be a large bill for geico for a job that wasn't approved for and they can get taken to court and finded so just be sure on what your gonna do and what could happen if things go bad.

Yeah yo accidents, those bastards that hit, and insurance companies suck. I had a lady swipe my entire side while i was at a red light and she double parked in nyc, and was trying to fix her parking. I got out of the car and i was like woww are you retarded? She is like ITS YOUR FAULT LOL im like LOL I WAS PARKED AT THE LIGHT. Basically the _____ didnt want to pay the 800$$ it takes to just paint the side of the car. So this is what i did. Got me a lawyer, teamed up with my insurance company. Gave her a 3 month time period to give me the funds. She didnt so we threatened to sue her for three times as much, and i got my money next week :D

So yay lawyers!


Good luck, that really sucks i know it feels when your baby gets hurt.

yea man geico is great at taking ur money, but paying for damages its the worst! they wont give money for unnecessary parts and extra paint costs....those express repair places from geico are quick because they stock bumpers fenders and other ____ re-engineered from taiwan which dont even fit right, u gotta keep fighting and ask a lawyer

To be honest, you do not need the whole car repainted. When I had the bumper on my blizzard pearl RS3.0 tC repainted, the body shop did an immaculate job and not even the dealership could tell it was repainted when i traded in my car.

My Insurance recommended Toyota Scion dealer repainted my rear quarter and to match it they repainted a perfectly good left rear door too to b l e n d in the difference in color - yeah Polar White . . . how hard could that be? - they also repainted the rear bumper which I liked because the thing was micro scratched on top anyway but the rear hatch didn't match the new rear quarter or the bumper so . . . . what a waste of time painting the door.

Never gonna get the whole car painted........just won't happen over a 15mph fender bender.......so drop it with the insurance guy.

Now in your case you have an RS4........the paint color is availabe through PPG,cost about $75 a quart at worst.......

New bumper is $250

Grill for your car is gonna cost them more than the bumper and paint probably and they have to replace it,God help them if your front lip got scraped or screwed up as few shops will waste the time to repair poly parts and will just replace with new........and in your case RS body trim parts are costly,ask anyone with an RS3.......Kenstyle kit is super spendy.

You also have the right to go through your insurance and get it repaired and they can bill his insurance and you wait to be refunded your part of the deductable....which takes forever...

Any person has the right to take their car to any shop they want,and any car damaged has to be repaired back to the way it was prior to accident....

I will give you a hint of wisdom here...I had to goto my insurance agent with my car and get an agreed value of the parts I put on the car for them to be insured.......if not agreed on prior to they do not have to cover anything short of stock OEM parts.

the rs4 lip kit and bumper was damaged.
the upper and lower grilles were smashed. 15mph or not, did some damage, suprised me how much it was.

Luckily you can get the RS kit pieces sold separately.....but it is gonna be spendy......Five Axis kits only sold in whole kits....I am hoping to never get rearended again myself cause I may flip out on the person.....lol.

A GOOD shop can match it.
A so-so one can't.
While I 100% empathize with you, you can't demand a total repaint.
Find a good shop, get it fixed, move on.
Or, claim your neck was injured and you're going to sue them. ;)

Give yourself some time. Your neck and back may start hurting you up to 3 months after the accident. Believe it or not even a simple 15 mph crash can cause some serious pain in the near future. I was hit from behind by a girl not paying attention and have had neck pain 2+ years after the accident. My chiropracter gave me the information of a lawyer 4 months after the accident and she did a very good job getting me help. I only went to a chiropracter and the lawyer got me a cash settlement of 4000$ for the accident. She took 1/3 which is actually good as some lawyers expect more.

My girlfriend was in the same accident and used the same layer. Her case has not been closed yet since her pain has continued and she has seen quiet a few doctors now. She has to attend physical therapy twice a week and they did scans and found that she had a small fracture in her collar bone after the accident from being jerked fast.

Needless to say my girl will probably see close to 10x as much money as I did because she has been seeing 5+ doctors for a long time now over the whole incident.

Good lawyer = payment end of story.

Do not trust a TV lawyer or any ambulence chasers, you need to talk to people find out who in your area is good and possibly go outside of your area. I live in Philadelphia and the lawyer I used lived in Princeton NJ.

huh? well, prior to my scion i had a BMW e36 M3 and it had gotten into an accident. I got a whole new paint job out of the guy hitting the rear bumper/trunk.

^^you do know that most insurance companies send somebody out to look at the damage. They dont just go by what the shop says, more than likely they will have somebody look at it and if they dont think it needs a whole new paint job, it isnt getting one.
