Is using pictures of our cars to sell knock off body kits and other products.
I tried emailing them a few weeks ago, and recieved no response. I finally called them today, and the guy who I spoke with on the phone said there is nothing I can do because its the word Wide Web and he can do what ever he wants with my pictures that I post online. I asked him about selling a Type K kit that is really a Kaminari kit and he said he has nothing to do with all of that.

What can i legally do? How can I get the pictures removed so that this company no longer makes money off of my hard earned money spent?

If anyone else knows the screen names of the other tCs on the website above please send them to this thread.

Anyone that has extra time that wants to call and harass this dipsh$t, go ahead and annoy them.

You ought to take pride in UR ride my man.

I'd ask that comp. for some referral fees for advertising UR pics.

 

I take plenty of pride in my ride. its the fact that I spent so much money on my ride and now another company is using it to make money and for free advertising.
The guy was a straight @ss on the phone to me.

 

Just because a picture is up on the web does not give everyone permission to use it(I'm pretty sure atleast.). If it really bothers you tell him that if he does not remove or pay royalty fee's you will pursue legal action...especially since he is profiting off your ride.

Edit.
I was looking back on some of the pictures he has up and upon closer examination he has his watermarks all over the photo's. Their not his pictures he has no right to put those watermarks on those pictures.

 

Here's the deal.

It's in violation of US copyright laws. It was copyrighted as your property the second it was created (in this case photographed and downloaded to your comp)


Here's the bummer. Copyright lawsuits require copyright registrations, meaning for every piece you try to sue him over, you would have to register, and ultimately prove it was yours.


IE. always digitally sign your pictures that you want kept off of these websites.


Long story short. You either pay money, file a lawsuit(pay more money), and have them removed off his site, or ____ and moan.

It sucks... but such is life.

 

yeah that thing he said about it being on the web is total bs. lawyer up and send him a notice.

 

Call Kaminari, they are trying to shut down these fake kaminari manufacturers

Got off the phone with Kaminari. The guy got ____ed as soon as I told him. I gave him the website and he said dont worry he will call them immediatly and have it taken care of.

I wish I could afford a lawyer to take care of it. I have called other companies and they always appologize for putting my pictures up and remove them. This guy was rude about it and told me thats the way the web goes.

I think the 2nd tc that is Red/Black 2tone is one of our members car, It does have the SE banner on the windshield, I wonder if he knows bout this.

I got an even better Idea, it does sticnk that there isnt much that we can do w/o breaking our pockets, but we can post his number on sl and on youtube, just make a video and have everyone call him and tell him how shady it is, imagine if everyone on sl and other scion owners would calll this guy just at random times LOL im gonna call him everyday and day and bs him in and out every chance I get at work, I HATE when people like him try to make money of things that are not theres. Ill make a bunch of calls to him and try and make a video for everyone LOL.

Yep i was right, it is him, even though his pics are updated, the 2 tone is still the same, he just has the body kit on there instead, the one in the photo for the site.

 

If they are showing a picture of your car with Product X, and then claiming that this is Product Y, then aren’t they guilty of false advertising?

I don’t know what legal rights you may have in regards to “pictures” of your ride, but perhaps Company X might be interested in this. After all, Company Y is displaying Company X’s product and claiming it as their product. They may be interested in pursuing legal action if it can result in eliminating their “knock-off” competition.

i was actually snooping around on cardomain.com a while back and noticed my car on there. Well i already have one but it looked like someone made another one and said i had LED's and fartcan exhaust and all the other rice trimmings. I told cardomain about it and they removed the page. Im about to get my pictures watermarked all over now!
