I just came from my hearing and have a ten day waiting period to hear the results. I did learn something when Toyota tells you they are sending out an FTS inspector to inspect the vehicle we should all check credentials because the one that we met at the dealership that decided there was nothing wrong with our braking system was at the meeting today and when I asked him if he was a certified by the state of California to be a mechanic, I FOUND OUT HE IS NOT A MECHANIC AT ALL AND HOLDS NO MECHANICS CERTIFICATION.
That is the meeting I came from today it is with Toyota and National Center of Dispute Resolution. I will post results when I get them. Hope for Lemon Status. If not I will trade in and get new one.. I can only hope they will not resale this car but destroy it.
Great!!!
Bossy, if possible, and if you are comfortable with it, could you please feed us some detail about the letter - and keep us informed, of course, about how things work out for you.

Couple ?'s....
I'm not sure how Scion does it, but in my last car, the master cylinder was ahead of the ABS pump in the circuit. Meaning, if one wheel locked up, it's most likely the pump's fault, not the MC. The MC feeds pressure to the pump, and the pump inhibits that pressure if the need arises.
The brakes randomly lock up. Meaning, just driving down the road, or while you are in the process of normal braking for whatever reason?

This is how mine reads:
After reviewing the complaint(s) and hearing the proofs and arguments of the parties and taking into consideration the applicable manufacturer's new vehicle warranty, and the applicable law including the applicable State Statue commonly referred to as the "Lemon Law," and after due deliberation, I find and Award as follows:
The Customer's request of Replacement/Repurchase is hereby: AWARDED
I have reached this conclusion because:
The customer provided what I deemed compelling evidence in support of her claim in the form of repair orders and her testimony that the problems with her vehicle involve a substantial nonconformity (i.e. brakes or braking system). It is my award that the vehicle be replaced or repurchased.

Hi, Bossy. I have two things to say. First, your braking problem may be from a bad proportioning valve or an intermittent problem with the abs computer.
If you are having problems getting a replacement, you might have to force the issue. Let them know that you are well aware of the abundant availability of replacement vehicles. Then let them know that you do not appreciate their insincerity and that you are considering having an interview with the local newspaper about the mistreatment, lack of professionalism and ethics at their dealership

I would hope they will figure out what the problem is after they get it back to their Engineers at the Manufacturing Plant. I should hear more today. I have agreed to give Toyota 30 days to comply with the arbitrators decision. Then I will enlist the help of outside sources. The deadline for compliance is May 29, 2007. I hope this is resolved before that date, so as my son may have his own vehicle to drive to all his Senior Activities for High School.
To be honest it sounds to me like your brake calipers are sticking which is why your pads are wearing out so quick as for the locking up part i dunno.... are you driving along and it locks up or is while you are stopping it locks up? cuz if its when you are stopping my guess would be a stickly caliper. if its while you are driving i have no idea then.
