So last night i was driving the speed limit it was raining, and dark, i came to a curve in the road and all of a sudden i saw a vehicle with no lights on and realized that they were in my lane and they were going pretty fast! So i swerved into their lane to avoid a complete head on accident and we both clipped each others passenger side. I was going 55 she im guessing was going 65 at least. My car i believe is totaled unfortunately. i find out the other driver "she" was drunk, like plastered, had a big history of traffic violations an..... what she did is considered a felony and she is now in jail. bad day for both of us.
So I talked to the insurance company and i do have uninsured motorist coverage. So i am going to be getting some money for my car yay! Thanks everyone for being concerned. So I'm asking for any advice of what to do, the police officer says suing her would be like trying to get blood out of a turnip and i dont think im going to get what my car is worth out of the insurance company. PLEASE HELP with any advice. heres some pics

Wow glad you are ok! I will still sue the crap out of her and take it as a serious life lesson to have a very nice car and not have full coverage...

 

Try and get as much off the car as possible, sell everything, and sue the pants off her! That way you can get "some" money back and you dont have to have a total loss!

Sucks about the insurance thing though but . . . if you have a 'medical injury" isn't the other's person's insurance liable for your pain and suffering?

No i didn't have a passenger, and i really dont have any injuries, and even if i did, the other person didnt have insurance.

 

So im not really sure about selling everything off of it, there aren't very many xbs in alaska, btw the engine is allmost completely untouched it was actually running when i stopped, and i turned it off. do you think i could sell the engine, how much do you think i could get?

 

sue her and sell everything one your car. looks like you grill is in great condition

 

pull as much as you can off the car and sell it on EBAY.
get a lawyer and sue her. i know i know, she doesn't have any money. small clames courts are different now. befor you could take someone to court and win a judgment and the persone would stiff you and it would just go against thair credit and over to a collections.

its not like that now, if you win a judgement that person MUST pay you. or go to jail. its just as bad as child support, alimony, or restitution. besides she was also in the act of a felony...... DUI with property damage.

GOOD NEWS UPDATE!!! I called the insurance company and i found out that i do have uninsured motorist coverage. Not full coverage but i am stilling getting some money!!! Wow that is a serious relief. anyone have this happen to you how much did you get for your xB? And thanx everyone for being concerned.

 

that's good that she is in jail. I don't think you have any other option other to sue her. it's either you do and get money or don't and get none, imo

 

I talked to the officer and he thinks suing her isnt going to do me much good, because she has nothing and she is going to be in jail for a LOOOONNNGGGG time. She is convicted on a ton of stuff including a felony. Anyone have advice as to how to get the most out of the insurance company?
