xB caught fire this afternoon..

Ok here is a new update.
My insurance wants to give $11,250 for the car which is the private party for a non RS model xB. Thats not a big deal really because i have GAP. My problem now is that they want to give me $250 for my $1200 rims. But they are taking the price of the rims and adding it to the value of the car. Making the value $11,500. I sent them original reciepts for the rims and an original window sticker for the car showing the full value and the fact the rims were not included. Do you guys think it is too much for me to ask for a check for the value i paid for the rims since i paid for them out of pocket?

Second problem Im having:

The investigation last week said the car was a complete loss obviously. I bought the car on 7-20-2007 which means the 3 year/36k warranty is still effective plus i bought the 5yr unlimited warranty anyways. The problem here is, ever since the investigation, Scion will not return my phone calls about if they are willing to cover the value of the car or not. Second question is, should I go after Scion about covering this and forget about Statefarm all together?

First off: IANAL!

I would think that Scion should be on the hook for this, not State Farm, but I would do some quick checking about that first...

First, I'd check with your state's attorney general office, especially if they have a consumer protection division, to see if the total destruction of a product due to a defect should be covered by the manufacturer. Second, if that is the case, I would approach State Farm with the information to see if they want to pursue Toyota on that instead of paying out their own money. Lastly, if State Farm were not interested in that, and if your state AG believes it should be covered as a defect, decide if you want to try to pursue anything in that direction.

Alternately, just take what is offered...

personally, I would let your insurance company go after Scion if they want to. That's what they do.

And I'd demand more for the rims. You may not get full price, but they didn't depreciate 85% in two years.

Well all Scion had to say was that they could tell the location where the fire started, which was the left rear side of the radio. Their answer was that there is no way for anyone to be able to see exactly what caused it because of the extensive damage.
So they told me they will not help at all....I think this is complete BS on their part. The car is still covered by the factory 3yr/36k warranty plus I purchased the extended 5yr/unlimited mile warranty when I got the car.

And as stated before, the car was ALL STOCK as far as electrical system goes.

The problem with that logic is that many of the parts on the box are made by third party providers and bear their names, but once provided as original equipment by Toyota on one of their cars, it becomes a part of the vehicle and is warranted with it (with the exception of battery and tires, which carry their own manufacturer warranties).

If a Denso relay under the dash shorts out, it's still part of the car and repaired/replaced under warranty. If the radio itself fails, it's repaired/replaced under warranty, same for wiring, same for switches, etc., right down to individual LEDs.

If one of those items fails and causes some wiring to burn before the fuse blows, it's Toyota that repairs or replaces if the vehicle is still under warranty. Even if it takes out the entire car, it is still a warrantied failure. (That covers parts and workmanship.)

The only exception I can see there is if Toyota wants to try to hang the dealer for a crappy radio install, maybe a pinched wire or something. In any case, it's still warranty.

(I'm truthfully amazed that State Farm isn't pushing in that direction.)

I'm sorry to hear that Scion is giving you such a tough time, I am with you, i would think since it was still under warranty, you should be taken care of.

I hope they end up pulling their head out of their _____ and take care of you.

it seems to that insurance companies don't see RS as anything special. it just says xB on the title. not xBRS or anything. you most likely won't get alot for this car thru insurance or anyone

...and that can be both good and bad, JDMJim... Good in that they don't charge extra to insure a "Limited Edition" and bad in that they won't pay extra for a "Limited Edition."

Well, I gave up on Scion because I don't have the time or the money to get a lawyer and go after them for this. State Farm ended up giving $14,500 for the car so its all paid off now.

I plan to be a one car family for a while until I find something I really want to buy.

Dammit man that still sucks though. Scion should have been like alright its covered our bad here's a new car. Hopefully since ur insurance was involved they don't raise ur rates.

Happened to me, I paid everything out of pocket when I crashed my car and they still raised my Premium.
