Was he driving perpendicular or parallel to you? Guessing it wasn't your fault, but an image would help. I'm happy to assume that you're OK since you're still posting.

Depending on what state you live in, the op could be placed partially at fault (yeah sucks I know).

Sorry about your loss...

sorry. That sucks. I had close to the same thing happen to me with my gen1 box. Get a lawyer because even though I was not at fault 100% by the police report there's still a lot of BS with insurance and so on.

Yup! The impact spun my car around. They said that it was fixable, but.............?

Glad you are OK...and I hope the surf was good.

Fixable? How is the frame? Is it mainly just exterior damage? Did airbags deploy?

Driver-side air bag deployed. Got a little burn on the forearm. The frontend is tweaked and I am concerned about any major repair because I have a newborn in the family.

The impact spun my car around a bit. Surf that early morning was not very good and I won't be surfing until after I get checkout and get cleared.

If you have good insurance though, they will have a good lawyer.

Superbowl Day, 2007, I was side swiped on the 101 Fwy near Rampart in my 4Runner. I was pushed over into next lane to the left swiping a Sequoia. The car that initially hit me took off, while the Sequoia and I pulled over.

Long story short, the Sequoia had 5 passengers, one claiming injuries (even though at the time everyone was OK). Although my car sustained damage on the right side, my adjuster(from AAA) said it was my fault and apparently paid for damages to the Sequoia. In the meantime, the folks in the Sequoia got a lawyer and wanted to sue me for more damages etc.

My premiums went up, I was upset about it...but nothing I could do. In the meantime, AAA was dealing with the case and lawyers, and assigned a lawyer on my behalf. Just this past month, the AAA lawyer on my behalf got the other party to agree it was not my fault(proved by pictures of damages on my car). The other party is going to claim uninsured motorist. My premiums will go down, and I should be getting a refund of some sort for the higher I premiums I paid the last year.

Which reminds me...I should give them a call tomorrow.

I understand your concern. They are usually pretty good about making sure the car is fixable. They don't want things to come back to haunt them later.

Good to know the car protected you though.
