They do have a frame straightener. I saw my car on it. It is sitting down at the shop right now and tomorrow morning im going down to let them know whats up. i also have some other problems that were not included in the original quote i have to get the insurance to pay for, but yeah im not a "ill sue your ___" type of guy but at this point i went from loving my car to not wanting anything to do with it.
to be honest i would be talking to a manager or possibly the owner. I would be requesting a new car. They did not fix it and to be honest it looked better rear ended..... Regardless of what happens don't back down until it is done right! not to mention regardless of if it is fixed that car will not be worth what it was before it happened. That will be in its history and you will never be able to get what you should out of it! I would have been after a new car period!
I just got rear ended on Thursday night as well (actually sandwiched). I am still waiting on a statement from the woman that hit me, so I don't know if they are going to fix it or replace my ride. I'm worried that they will want to fix it, and end up having no resale value






If TonE stated that his damage was 5k, then they should total the car no matter what. From what I understand, if damage exceeds 50% of what your car is worth (kbb on a 38k 08 manual xb is ~14k) and there should be at least 2k in damage up front I should be good. With the rear doors not opening, the frame is bent for sure.

The insurance company sent out a adjuster for an estimate. He quoted my damage at $9,600.00 to fix my smashed tin can. I found the most expensive body repair shop in San Diego, which happens to be at the Mercedes Benz dealership. I just got news that the frame is bent at least 4 inches forward, and the unibody is beyond repair.
I rely enjoyed my xB, for all the space it had in it.. ( Folding the seats down with blankets is wayy better than any back seat ;) )
I am torn between another xB or a VW GTI...

Actually the way the market is right now the insurance companies are not totaling much. They are trying to repair as much as they can. I was up at a friends body shop the other day and they had a 02 tahoe there that was like $3g less then blue book on it and they would not total it. They (the insurance) wanted it fixed. It was alot like the 2nd gen up here. It was rear ended and smashed the front and back really bad. So the rule of the 50% is not really always true.
Sorry to see the xB's cruched like that though. Glad they stayed together they way they where supposed to.

O.k. that is just sick and wrong!!!!!
The pick of the"after" tail light looks more like a before. Do not accept it back until its right. I was hit in my 06 and they started estimating the damage at 5600. then it went to 7000. then to 8600. and they told me it could be more once they got inside and started looking at things. So here is what you do: Get on the phone with the insurance company ..if you were hit you may be talking to the other drivers company. Tell them I am super picky, this car was my baby etc... and this car will go back a hundred times if it has to to make it right. They are not going to want to keep fixing it forever.
They may or may not total it but in my case they just realized I would not go away until it was right. At the least you should take it to another shop... The other shop will send over a truck and pay off any tow fees you own to the first. Look you invested 16,000$ or so and you have a right to not be returned something that will have no resale/ trade in value. You sound like a nice easy going person, you don't have to be a total jerk just be firm and stand up for your rights, believe me that insurance guy would do the same thing if it happened to him.

Nice catch. I was too busy looking at all the damage....
As the story unravels.... The insurance company (USAA) totaled out the car, and gave me a reasonable settlement. It was enough for a down payment, and to get some new shoes for my ride.
After shopping around, and trying to find a car that I would like better than the xB, I decided to purchase a 2009 BSP xB. It sure is nice to have a new car again, but the whole insurance process is very stressful. Thanks all for your input.
