Default DEAD tc :-(

well, earlier this week i was in town and some lady changing a cd slammed into the back of me and pushed me into the truck in front of me. Her insurance adjuster called me and told me that she doesnt have enough coverage to repair my vehicle!!! She estimated about 10k damage :-(. So i had to file a claim through my insurance and let them fight with geico (her insurance). So im waiting for my adjuster to go take a look at my car and I'll probalby have a say so in if it gets totalled or not. If it does, I'm just gonna go get another one lol as long as i dont have to wait forever. That means im going to have another set of stock rims/tires to sell (for cheap). I"ll get some pics up asap.

How can she have less than $10K in liability insurance, isn't that illegal? Better have that lawyer ready.

insurance isn't required in all states. in ohio it is, but you need more than $10k

Insurance isn't required in all states?! I know collison isn't as long as the car is paid for but liability? What states are these so I know never to drive through them?

well, her adjuster couldnt tell me how much coverage she has b/c of the privacy crap, but it has to be at least 10k, which is why i said it probably will be up to me if i want to total it or not. Because I have to do everything through my insurance now, my adjuster has to go and get an estimate on the repairs. If i want, i can tell him to be very detailed and get the estimate high enough so thats its totalled, or try to keep it low enough so they can repair it. So i just have to sit on my hands until the end of next week

sorry to hear that... did you get heart if so sue sue sue this is America to sue some one for stuff like that is so worth it, you my get more then 10,000.

If the damage is as bad as you say it is, go for the total. A previously wrecked car will have a sh!tty resale/trade-in value not to mention any bugs that might creep up after it's fixed, the car will never be the same as before. At least if it's totalled, you can take the money and get another new tC.

New Hampshire, I believe, is one of them.

If it's a 10K hit you better push for a total becuz it will never be right when you get it back. Just my opinion (Wife works at Body Shop)

WI doesnt require liability??? I live in MN, so I will stay the hell outta there. I cant believe some places are dumb enough not to require liability still!!!!!

But, if she has liability, she has more than 10k. Call a lawyer.

Looked this up online.. a list of the places that dont require liability. Dumbest thing I have ever heard.


Every state except Mississippi, New Hampshire, Tennessee and Wisconsin requires some level of liability coverage.

depending on the insurance company you have...if totalled you can buy the car back at cheap...i bought my Prelude back from my insurance for $250, and got my money it was worth (was more than it was lol), later i sold it for a g.

i say if you get the option to buy it back, do it..then part out the car and get all you can for it, then sell it to a scrap yard or something =)

In Louisiana, as in many other states, the law only requires a minimum of $10K liability on property damage and $10K om bodily injury. Anyone stupid enough to carry those minimums better be ready to get spanked if they have an accident.

As for what you can do, it is all going to depend on your total damages. I find that more and more insurance companies will not bother to sue each other. The costs are high and they would rather just pass the loss on to the customer. Just watch the cost of your insurance go up if your own company pays out anything. If the amount is small enough (you have a $3K max in LA), small claims court is easy. If you are out more than that, get an attorney. If the person who hit you owns anything, you can attach it when you win a judgement. It's worth the hundred bucks or so to do an asset search on the person who hit you before you hire the attorney.

For everyone else, check your liability coverage. If you are driving around with only $10K, think about increasing it. It is not that expensive to carry even $100K.

^^ good advice. I was hit once by an uninsured 17 year old (I was 1. Totalled my truck, which was older and had liability only on it. His family had nothing to sue for, (I think he made more than them, but owned nothing) and it was his third offense for driving without insurance. I got squat. Not much happened to him other than a some violence thrown his way (by an unknown source of course )

Moral of the story, PURCHASE GOOD LIABILITY!
