Default Taking a parking lot to court.

Well. My car was damaged at a parking lot.

THis is the story short and sweet.

They left my vehicle in gear w/ no ebrake. I autostarted the car. It drive into a fence at about 3 mph.

As i see it i am partially responsible. But i feel they are aswell. They were supposed to get my vechicle not just give me the key and they were supposed to engage my ebrake.

Aside from the usual useless comments about dont park there again. or dont autostart.

Can anyone share some info about anything i may be missing?

also, im looking for the page in the owners manual where it says the ebrake should be applied everytime the car is parked. Anyone know the page?

Double check with the signs and crap hey have posted there. They may have something to cover themselves.

and the spot you were parked in, because if you were in the front or out by yourself, they will sometimes let you go get your car yourself, they have done it me and my folks

as i understand it, its illegal to have autostart features on a manual.

In my honest opinion, I think you're screwed. They didn't know that they couldn't park the car in gear, like you are supposed to. I don't know if their actually is a law stating you can't have a remote start on a manual, but most shops won't do it exactly for this reason, the liability.

I wish you luck, but it might just be cheaper to pay for the cost of fixing your car out of your pocket. Always keep in mind that if you lose, not only do you have to fix your car, but pay for court costs and a lawyer if you get one, which I would or at least go talk to one before you hand the parking garage the papers.
