Default Got Into My First Accident Today.... **UPDATE**

yeah I thought I would never have to post one of these threads, but my luck ran out today.

Just got done having lunch and went over to my buddies apartment to find out he wasnt there. So as I was exiting his complex onto a major street I was stopped completely waiting for traffic and as soon as traffic cleared the guy behind me decided for some unknown reason to squeeze in on the right side of me and go the same way as I was.

As soon as the car was in motion all I heard was *crunch* and I immeditealy thought it was that car. Now the way the entrance and exit is set up in his complex is just a entrance/exit way no turn signal lanes....nothing. I had my blinker on and for some unknown reason he decided to go in which he denies seeing, but again no witnesses. He couldnt even fit through all the way because his bumper was probably literally against my front passenger quarter front fender. So when he seen me go he decided to fit all the way in there and unfortunately we collided as we went the same direction. Should of stayed behind me like the way it was set up.

No injuries, but the whole passenger side is completely tore up, scratched, and dented u name it. My brand new tC with less then 2500 miles completely ruined. All because this guy couldnt wait a good 3 seconds after me. The damage to his car was minimal I just cant figure why my car was so messed up.

Initial damage is 4500, but I already have the appointment set and the parts being ordered this min. Sucks, but thats the breaks. Hopefully his insurance accepts liability from a insurance standpoint on the damage sustained to my car.

cops stated it was private party and to exhange info.

My insurance is going after him. The dude was disabled not to mock the disabled, but he couldnt even walk which may have something to do with it and the fact that the sun was out today and in our direction perhaps he didnt see the turn signal since the tails are red.

Honestly I am going to fight this. I have statements coming from my friend who lives in the apartment complex stating that the way it was setup means just one car at a time right or left.

Two I am going to have them go out and take pics of the exit just to see where I am coming from on this.

here's my opinion. if it is one lane to exit right or left (or straight) or you were in the same lane delineated for folk going in the same direction as the guy who trashed your car, he had no right to "go past" even if you had no signal or the wrong signal on. obviously, he had to wait for you to either go straight, turn right or turn left.

if however, there is a delineated lane (not just room) for him to go around you and you turned from the wrong lane because you changed your mind mid-turn, he was in the right. lines in the road will decide this argument. it's pretty simple

all kidding aside "SinisSick" i really think it's just god reminding you not to judge people. imo, god hates that "holier than thou" mentality.

i'm just kidding.

i could be wrong.

wow, i might be the only one who thinks this...but are your really gonna take money from a disabled person. hell when i had my old car, a lady backed up into it... she was maybe 65... and we swapped insurance and all, but i could really go after an elder ... but its up to you, maybe you should just go through your insurance.

Ok, I think that is horrible thinking. Just because they are disabled or old means they have the right to ruin what he payed good money for?
Maybe they need to be taight a lesson that if you cant drive without causing an accident you shouldnt be driving.
I have no problems with disabled people or old people, but an accident is an accident. There should be no special treatment for them. There would be none for me if I did the same thing. So whu should the law turn a blind eye on elerly people or handicap people?

As a person that gets paid for doing investigations like this:

Get pictures at the same time of day showing exactly where the cars were, use the same cars if possible.

Get pictures of any curb rash that may have occured, or tire tracks in grass, dirt, or flower bed.

Get pictures from front, back, and side of car and or cars to show relative bumper match to damage

And for those that are talking about taking money from a disabled person remember, thats what you pay insurance for, comes out of their (insurance companies) pocket.
Just because someone has a disability doesn't give them a right to not know how to safely drive.

Bascially the guy made his own lane....I already told my adjuster that I will get statements of my friend who lives in the complex as well as some of the people who were there at the time, but didnt see the accident.

As for lanes its really simple. One entrance and one exit. 1 white line seperates the two.

I waited there for 30 seconds as I had to go to a shopping complex diagonally right of the exit, so I had to wait for all oncoming traffic to clear. The guy didnt have paitence and this is what happened. Honestly since I was there for 30 seconds "if" he had the room he could of went around me with ease, but again he had no room to do so. Just justifies how poorly his decision making is. Also he states he "didnt" see my blinker, well really how can u when ur trying to make ur own lane and the sun is in ur face. Again defensive driving wasnt exactly his good attribute.

Also I told my adjuster to send someone out to take pics of the exit where it happened to see where I am coming from and determine in their perspective on what exactly happened.

Just waiting for the call to determine he denies all fault. Update soon as with pics.

Oh and to the disabled honestly I have family members who are ill and so forth, so it's no knock to them. Again u have to realize I did everything right and was paitent because I obviously didnt want to cause a accident of my own, so I shouldnt have to put money out of my pocket and have my insurance rates go up for someone's stupidity.

We swapped insurance did everything in the correct manner and acted like mature adults. Yes I was ____ed in the beginning, but as I got out of the car my concern was to make sure the other party was ok.

The guy was disabled he could barely walk not sure if something had to do with this, but he may had been in the hurry to a doctors appointment, didnt take his meds, I have no clue. I felt bad for the guy, but we ended everything with a handshake. Like I stated he was clearly at fault and whether ur disabled, retarded, have 3 *****, or 2 vagina's if ur at fault u have to step up to the plate.

That's why I pay the insurance to actually handle these matters.

As for you congrats on having a IQ of a dumpster and I'll make sure to send u a cookie once I get a batch finished. Idiot.

Well if he cant walk already. i guess if he doesnt pay you you cant go break his knee caps...

All jokes aside.. That sucks. But in discussion of handicapped/elderly folks, My car was hit by a 85yr old lady in a 1970s BUICK that ran a red light. 16,000$ worth of damage. Hell yes i went after her.

Dont feel bad about pursuing him, He is at fault, he should pay, Even if his legs dont work, his hands can still fork over money.
