Thats why you alwyas call the police no matter how small the accident is....even if you think its your fault, they might have warrants, etc. and end up having to take responsibility!

Good luck!

If my vehicle is in an accident, I first check for damage and injuries, then call the police, then get name and phone number from any witnesses so they aren't delayed in getting on their way if need be.

I always write down the the driver's name, driver's license number, address, phone number, license plate number, the VIN, a quick basic description of the car, the info from their insurance card, a brief drawing and description of what happened, description of damage on both vehicles, and the exact time, location, and weather while we wait for the police to respond.

If the police prefer not to respond (more and more common these days) I at least get a report number from the dispatcher and add it to the information I have.

It gives me a starting point if it turns ugly.

If the driver does not have or refuses to show any of that info - I communicate that to dispatch and insist on a dispatch.

(If I have a camera I take pics, too...)

Only once have I ever had to go after someone, and having a complete record helped me nail them.

I hope you have enough info and can get an adequate response from the police to resolve this.

(I carry pre-printed forms with blanks to fill out for all that info, and a pen, in my glove-box to remind me of the info I want to gather...)

I wonder if I should sticky this list somewhere on ScionLife? (It's from the California Bar Association.)

What information should I gather at the accident scene?

Since many records now are confidential under the law, you may not be able to obtain the information that you want from the Department of Motor Vehicles (DMV). So be sure to get as much correct and complete information as you can at the scene of the accident.

You and the other driver should show each other your driver’s licenses and vehicle registrations. Then you should write down:

* The other driver’s name, address, date of birth, telephone number, driver’s license number and expiration date, and insurance company.
* The other car’s make, year, model, license plate number and expiration date, and vehicle identification number.
* The names, addresses, telephone numbers and insurance companies of the other car’s legal and registered owners—if the driver does not own the car.
* The names, addresses, dates of birth, driver’s license numbers and telephone numbers of any passengers in the other car.
* The names, addresses and telephone numbers of any witnesses to the accident. Ask them to stay to talk to the CHP or police. If they insist on leaving, ask them to tell you what they saw and write everything down.
* Try to identify people at the accident scene, even if they will not give their names. For example, if someone who saw the accident drives off, take down his or her license plate number. Law enforcement officials can trace the owner’s name and address.
* The name and badge number of the law officer who comes to the accident scene. Ask the officer where and when you can get a copy of any accident report.
* A simple diagram of the accident. Draw the positions of both cars before, during and after the accident.

If there are skid marks on the road, pace them off. Draw them on the diagram, noting the distance they cover. Mark the positions of any crosswalks, stop signs, traffic lights or streetlights. If you have a camera with you, take pictures of the scene, and of the other drivers and occupants.

However, do not place yourself in a position of danger in order to complete an accident diagram. Be aware of traffic conditions and skip any measurements that could place you in a position of harm.
Make notes, too, on weather and road conditions.

If the accident happened after dark, note whether the streetlights were on. Estimate your speed and that of the other vehicle. Be sure to record the exact time, date and place the accident happened.

another thing you should try to do when you are in an accident is take their info directly from their license, so that they cant give you false info.

a tip that ive heard of is when dispatch asks if anyone is hurt you say yes. officers are supposed to respond to those asap. ( i havent tried this, just heard about it)

Here's my old form (I just realized it's over eleven years old):

http://scionlife.org/Scion_Docs/ACCIDENT_FORM.pdf

Use it as a basis if you want!

It's not as complete as it should be, but it works for me as a start. I usually have a couple printed out and in my glove box, "just in case."

If no one else wants to make up a better one, maybe I will just to give folks a better chance at recovery from an accident.

dear parents,

please have jack stands!!! I had a pair in my old place but sold them because I am in an apartment now. Its the least you can do. it would have helped a ton, when I crawled under my car and tried to change my exhaust. I just didnt have enough room to get the bolts to loosen up...
