Default Tint problem! Causing windows to spqeek and slow down!

Hey i got my tint back in December05, and ive been having this problem ever since...
the windows are slowed down and they sound like their struggling to get up. the tint man told me that the tint is drying it out. but they also said that the i should use wd-40, well, it works when its wet, and streaks up my windows, but when i clean the windows off, it gets cakey and makes it worse. so i cleaned them well with dawn, and tried to get most of the wd-40 off, and i got most, but now im back at square one. they start up and start to slow down, and when they get to the top they almost sound like they pop sometimes. has anyone else experienced problems with tinting the tc, where your windows dont perform as they should?

This is common as my tinting place told me. There are two pieces of rubber that press against our window. In order for them to tint the window they need to push on of them down. Make sure they pulled it back up

it actually is scratched slightly if you look at it in the light...
so should this be the tint persons responsibility to fix?
