TRD or AEM CAI
if you really really want to not have water sucked in, SRI.
But from those 2 choices, TRD does come w/ a bypass but works only when the filter is submerged a decent amount. You can get the same from AEM, but TRD has warranty if that matters to you.

I wouldn't get either! The only way you are gonna hydrolock is if you go through a puddle that is about 12 inches deep and you have the throttle open. Plus many companies offer a bypass valve so it achieves the same thing. Both the TRD and AEM are over priced and you will get better numbers with a different brand. I would suggest either Injen or Fugita!

if you buy the TRD intake, and it is new in box (not opened or tampered with) and installed by a scion certified dealer. your warranty will be valid (5 year / 60k miles power train).
as others said, TRD is an AEM intake, its just re-badged for TRD and marked up in price. Typically an intake will NOT void your warranty. Its a judgment call if you want to install it or not. You wont see a big gain from it (though you will hear a deep growl from the engine). Also, hydrolocking scares people when it shouldn't. Unless you plan on driving through large puddles where the filter will be in the water, you will be fine (not the BPV is good to have for just in case)

are you positive its not a sport part (refer to sports warranty)? a supercharger is consider a sports part, so i wouldnt understand why an intake wouldnt be considered the same. where exactly does it say what type of part it is? sport, or off-road / race?
