Thanks to you all who were concerned for everyone's safety! I appreciate it. Safety and well being are #1 when it comes to this sort of thing. Yeah, as soon as I got out of the car I was already assuming that insurance would most likely blame me for it, but accidents are a spur of the moment thing and everyone reacts differently. At least I know the people in the FJ saw the other car drive off for peace of mind if nothing else. Getting ready to check out some body shops and get estimates. I've heard really good things about the one in town here, Summerfield Auto Body. I took some daylight pics below. I hope I can get everything ship shape before the 31st so I can still go on my weekend vacation in Bristol, but I'm not going to get my hopes up just yet. From the 3 amounts I've seen posted, I'm guessing it'll be between $4k - $8k. I can tell the door, side skirt, quarterpanel and rim are dented/scuffed bad. The bumper caught a little scuffing, so that might just be cosmetic but we'll see. I'll keep you all posted (haha no pun intended). Thanks again for your support!

and on a side note, as a motorcycle rider, i really appreciate when motorists swerve into my lane. think about that, if that FJ had been a motorcycle and you had done this exact same thing. chances are the motorcyclist wouldnt have been able walk away. i couldnt tell you how many times ive had people come into my lane and ive had to slam on my brakes.. to AVOID an accident.
dude... so true. best thing he could have actually have done is honked... isn't that what its for? incase of an emergancy? to warn others? probably also should have slowed down. swerving is usually the worst idea. usually you don't have time to look and just swerve u'll end up hittin another car... most likely they'll blame him... sux i know but yeah i'd rather have flat spots on my tires then all that damage too.

Glad you're ok.
You've definitely got a new quarter panel coming - which will be very expensive. Hope you have rental on your policy.

If I were you adjuster, I'd have to find you at fault because the FJ damage was caused by you avoiding the accident. You can't cause an accident trying to avoid an accident and walk away free. In this case - even if the Stratus had stopped, you'd still be on the hook unless the driver were to step up and admit it was his fault - simply because he didn't hit you.

The moral of the story is, if someone it about to hit you and you aren't 100% certain you can safely avoid it - let them hit you. It's something I want to say to a lot of my insureds. It sucks, but this is the alternative.

Sorry for being such a gloomy guss.

wow that sucks. Well F that stratus and the FJ cruiser. They both dotn know how to drive. You shoulda told the cop if the idiot in the FJ wasnt driving slow as a sloth then this wouldnt have hapened. If i was the cop and wouldve found out the guy was driving that slow in that lane i wouldve given him a ticket. Stupid people need to stop driving.

eh... i don't think so. maxspeed is 65... MAX not minimum. that's the thing. unless you're actually impeding traffic... u can go as slow as you want. but either way. btw the other guy is 100% right... if you can't safely avoid an accident... let them hit you. it'll be there fault 100% irregarlessly

As person who has had a freeway speed accident.......it happens in a matter of seconds and short of hitting your breaks and swerving there really is not much you can do.......he did the best he could......I say good job of not having a worse wreck.......

I had a truck that was tryin to get into the right lane last night after our meet for whatever reason swerve into my lane to the left and run me out of my lane into the fast lane.........was not a thing I could do but swerve out of it......I was lucky the guy in the fast lane just passed me cause I had to take half of the fast lane to get away from the truck......no time to honk........not really time to even think abut honking....

I am glad to be ok as I was driving my Yaris......big 4x4 truck and Yaris makes me a munched ride.........

People got to get it together driving.....peoples driving habits are pretty poor the last few years.......

Glad to hear you and the other driver and all involved are ok.......looks like your car wil be good as new in a short time.....they will probably just cut off the skin and straigten out the under pieces or replace them as needed and get it back to new for you....

Anyone in their computer chair can say "you should have" and "you could have", I am facinated at anyone who thinks they can do better, especially at highway speeds where things happen so fast, and so many things are happening that you can't think of every single thing in the moment.

It's a good thing you are OK because usually accidents relating to an SUV turn out very bad. In this case, it's lucky you don't have mechanical damages.

(Not trying to threadjack here) There are a bunch of stupid drivers doing stupid things. You can do anything other than swerve out of the lane, such as honk, hit the brakes, or even let them hit you. You're in the lane and they hit you, automatically their fault. I've been in so many of those cases where I relied on my brakes to avoid cars coming into my lane and side swiping me at 75+mph (in the tC and Z). Fascinating isn't it?

An update for veryone. Damage is about $3,565. I'm getting a new rocker panel, used quarterpanel, remanufactured rim, new tire with road hazard warrenty, and they are repairing the door and bumper. I take it today to the body shop to drop it off and go get a rental. It will take 37 hours of labor, so I might get it back next week hopefully. I spoke with State Farm and got everythign straightened out and I'm waiting to hear back as to whether or not it will go against me. I did find some small scrathes that weren't there before on the passanger door in the exact spot I told State Farm the Stratus' mirror was at when he came over into my lane. So I believe he did come into contact with my car, but I have to wait and see if that's enough evidence.

ALWAYS get a police report. The cop was a lazy douchebag.
Yeah, they seemed pretty lazy when they showed up, but they probably just wanted us out of the way of traffic.

Sorry, but I'm in Summerfield, IL which is about 30 minutes east of St. Louis so Chicago is kind of out of the way. Didn't mean to mislead you or anything.
