Default 58 in a 55?

Ok so everyone has their thread about their stupid ticket on weather what they should do about it and well tonight i was lucky to have one of these experiences...

first of all i have a valentine 1

going up north in michigan = huge hills and tons of deer

coming up a hill doing id say 58 maybe 60 tops cause i was coming up a hill, at the crest of the hill i see lights coming towards me and of course i could see the rack of lights, in human nature i got on my breaks... i see him turn around right behind me and i knew i was toast for some stupid reason... i rip off my valentine 1 so hes not a dick about it (there LEGAL in michigan)

so he comes over and asks how fast do i think i was going? well "pleading the fifth" i say sir i really dont know i was just crusin up north he replys oh ur SURE u dont know how fast you were going... again i wasnt going to come up with a bull crap lie and break my rights. he then chirps back claiming he clocked me doing 75 (in dangerous hills, at 1130 at night, with deer galore, and my valentine didnt even go off aka NO RADAR) so he takes my info comes back with a ticket saying hes generous for giving me 5 over instead of the 75... so now i have a ticket in my hands with a civil infraction for 60/55.

any ideas? suggestions?

Should have asked to see the radar gun with your speed on it.

Appeal it in court and watch it get thrown out in pretrials. 5 over is a joke.

honestly... I'd ask for documented proof of the so-called 75mph b.s. if you honestly weren't going anywhere near that fast.

Here in Oregon, if you ask to see the radar gun they HAVE to show you. then the next question *if it shows the speed he/she clocked you at* ask "When was the last time this gun was calibrated?"

Also. in Oregon. I believe they have to give you a 5mph buffer on the interstate.
I got pulled over in a small town here. *Rogue River* for doing 26 in a 25. MAN are the cops in R.R. diks.... no ticket though. I told him I was doing 25 according to my DIGITAL spedo.. he did not have it on his radar gun and HAD to let me go.

well for one, it's michigan. Remember they are DESPERATE for more money here! And for that 5 over? Take it to court, fight it. You should've asked for proof.

I wonder if it was that new instant-on radar that only takes a split second to take a reading. But doesnt the V1 read those? I heard that they have to check and then double check. Should look into the laws about what the legislature says about radar readings and instant on. Thinking maybe he hit you with that quick instant on which I don't think is legal, a 2nd burst is needed to make it stick.

Once again they think someone young, is stupid, fight it!

yes. definitely take it to court. and if they are legal in michigan, I would bring it up in court that nothing went off.

and then ask about their calibration.

i agree with robocop and phobboi, don't worry about it but just ask to see the judge and tell him what happened and that you where on your way home from work.

i got pulled over in philadelphia and the cop gave me a ticket for speeding.

first off, philadelphia police do not use radar detectors, i know this because my brother is a cop.

second. on the ticked it said "suspect was seen traveling at a high rate of speed"

the cop didnt write how fast i was going on the ticket, because he just assumed i was speeding.either way, i went to court and the cop didnt even show up, so it was dismissed, when i asked my brother about it, he told me even if the cop showed up, i would have won because philadelphia police are not aloud to issue "speeding" tickets. they CAN however issue wreckless driving tickets.
Only pa state police can issue speeding tickets because they use radar.

wow that is terrible. fight it and let us know. I got a ticket for "following to close" recently and when i asked the cop how he sat in his seat (slouched or straight up) he looked at me puzzled until i told him that depending on how he sits depends on how much of his rearview he can see. It was dropped because the judge was nice and was like this ticket is bs and he should have not given it to you.

Yes that is a bogus ticket. I had a cop pull me over claiming i was doing 80 in a 65..when other cars were passing me...I was doing 68. I asked for the proof and he said there is no need. I then showed him my scangauge and Garmin which clocks my fastest speed for the day and sure as hell, they both said fastest speed was 68....Cop let me go. Butthole must of clocked another car and just wanted to pull me over cause im the young one and my car is different. Sometimes they like to just be dicks about things. Put them in their place. It's your right!

3 over? Just show up at court and they'll throw it out. Sucks that you have to waste a day and pay the court fees...but there is no way you'll get any points for that.

thanks guys yeah it just sucks its like 4hrs away from my house lol

and yes i can guarantee that it was the instant on,, (if he had it on) the V1 didnt even beep which it does pick up the instant on., he did ask me though if i had a "fuzz buster" and since i ripped it off i said no.. im gonna call the court today and see whats up 5 over is a bogus ticket because like if we drop our cars, change rims, and after like 30grand (miles) our spedo's are off anyways.

now looking over my ticket i noticed he wrote a 06 toyota black. would that consider as false? we drive scions lol

and in his remarks section he wrote 75-72-72... which i wsnt going

Well, the law would state that any MPH over is braking the law.

I know from talking with my friend's dad who is a state trooper in PA that they have to give you 5mph on radar since it is not that accurate. This is what I have heard, I don't know how to confirm it.

Here is the bad issue, traffic law is an easy way for them to get money from you and they may drop the charge or they may switch it to something without points.

It really depends on the judge, I have had judges that have done their job while others wanted copies of driving records and would give you the points or the fine but not let you off. He gave a 65 year old lady the points.

When I needed info on the last ticket I was trying to beat in MD (I lived in PA at the time) I called up the MD state police barracks and stated that I was taking a basic law course at the community college and my professor asked us to compare laws between states and that I picked traffic law. I said that my friend was was kind enough to give me a copy of his old ticket from MD and I was comparing this to one ticket that I had gotten in PA and noticed some differences and had a few questions. The Sargent was very kind at this point and gave me plenty of info even about the calibrations and how many cars were running laser versus radar. After all of this though, I found out the cop filled out the ticket correctly and then I got the judge that said "points or fine."

PS PA law states that it is a offense if your speedometer is off.

just got off the phone with the court..

105 bucks with 2 points.

or i can go to court and then the court will be based on the 75 he claims i was going.... and suggestions

mail the ticket in pleading not guilty of course...when they send you a court date, ask them for another one..you should be able to do this numerous times before they give you one last court date. On the ticket if he claims to have gotten you on a radar gun, the serial number or whatever should be on the ticket. In court make sure that the radar gun was not expired. if the gun was expired the ticket will be dismissed. 5 mph is a joke and you will probably be given a "bargain" ticket ex. parking ticket.. something that is not a moving violation. Also if you know anyone that is a cop it never hurts to try and have them contact the officer who gave you the ticket.
i've had my problems with speeding tickets so now i just hit cruise control on 63 when in a 55 and i have never had any problems with cops and ive passed them when they were shooting radar. something seems weird about the officer giving you a 5 mph over the limit ticket...i think he was in need of a ticket of two before he finished up the day so he probably wont even show up in court.

the problem is that you left the door open for him to tell you how fast you were going. you should have just owned up to your speeding instead of playing games with the cop. you were also untruthful about the radar detector, so that left another door open for your mistake.
