Default Accident ....

alright guys i need your help

this is the story
me and my friend went up to the canyons to chill. as we r driving back down my friend pulls over and wants to drive my car because he says im going to slow. so he takes my car for a spin right into the guardrail and bam my car is hit.

so i call his insurance company to let them kno what happen. i get a call back saying that its my fault that there insurance company doesnt have to pay for my car. IM LIKE WTF
then the guy tell sme to let my insurance company kno wats going on

he says that i just have to pay my deductiable and that my insurance company would repair my car without increasing my rates.

i talked to a lawyer he says its my fault for letting him drive the car.

i swear to god i had no idea that it wouldve been my fault if he crashed had i known this i wouldnt have let him drive.

so guys please help me out wat is gonna happen wat i should do and if that is the chase that my insruance is gonna pay for my car will my rates go up

btw i have 21st and he has farmers

please dont flame me saying i shouldnt have let him drive. i kno and dont mind my great grammer ><

You shouldn't have let him drive. I think the law varies by state, but usually you are liable when you knowingly and willingly allow someone else to use your car.

yes i kno that now but at the time i didnt and im a dumbass end of story but can u asnwer my question about if my rates r gonna go up

his insurance company told me its like the same thing as if it was a hit n run

Well, your rate will go up. There's not much else you can do.

I'd have him pay the deductible and the difference on the rate.

wonder if this will teach people NOT TO LET PEOPLE DRIVE THEIR CARS.... if they aren't responsible enough to own one themselves then they aren't responsible enough to DRIVE someone else's.

when you get car insurance, your insuring the car, not the driver. so you have to pay your insurance deductible to have your car repaired.

your rates will go up because you demonstrated poor judgement in letting somebody else drive you car because they told you that your driving too slow.

now, some drivers have full coverage that covers the driver no matter what vehicle they are driving.

for instance, my policy covers me when i'm driving a rental or loaner car.

now if your friend is really your friend, he should pay your deductible and maybe cover your premium increase for a few months, or so.

and learn from this, never let ANYBODY drive your car. unless it is an emergency.

Oh man, my favorite route. After a crash on Angeles Crest, you are lucky to come away with your life. Many of the corners on Angeles Crest have a 500ft+ drop if you make a wrong move. That guardrail probably saved your life. I hear about bikers dying on that road all the time.

Well I live in Cali and I got into a wreck over 5k per car and my insurance just made me pay for my deductible and my insurance atually lowered and im 19 3 speeding tickets and 1 accident all on my record and im on my own plan through progressive.

I'm still curious how close you came to dying. Was there a 500ft drop on the other side of that guardrail?

eh ive been up there alot and yea there was a massive drop but honestly when it happened all i was thinking about my car nothing else.... i didnt even notice the drop until u guys talked about it here.





but good news i talked to my insurance today they said that my rates will not go up at all and that my friend will get a point on his record.... and he is paying for my 1000 bucks deductable.

your lucky your rates don't go up because in this incident you demonstrated poor judgement, but hopefully you learned something from it and luckily nobody was hurt.

Feel fortunate as well that 21st century (used to have them when I lived in Cali) covers other drivers other then yourself in case of an accident. Not all insurance coverages offer that, and if they didn't, you'd be paying for all the repairs.

Sorry, but that is the way it should be. You pay for insurance on YOUR car, as does he. If he had a friend with a Lambourghini and he smashes that for $50,000 his insurance company isn't going to cover that. They insure his car, not everyone else's car on the road.

My insurance covers me on any car I drive, it also covers others who drive my car. Not all insurance companies are the same.
