Default Damn. Cops. *Final Update*

Hey guys, I have a small problem. I just turned 21 and I was at a party over at my friends house, and I didn't have that much to drink, maybe a casual 3 drinks. Me and my friend decide to leave at the same time at around 3 am (separately). So we drive away in both our cars, and he pulls up next to me (we drive the same car, same color) to drive side by side, and we drive down the road, doing a little revs and bursts of speed, but nothing like straight racing. I turn off on my road and park at my condo, then come inside. As I am ready to go to bed, my friend calls me and says a cop pulled him over. I was like ____. Then he said the cop called for back up to find me in the turn I took. Apparently he saw us vrooming down the road from afar, and followed my friend and pulled him over. Now I checked outside and bam, two cop cars are sitting in front of my parked car. I can see a laptop open in one of my cars so he's obviously checking my info. After a few minutes, both of them drive away (I live in a condo so theres a door code to get in, so they can't just come up and knock).

I woke up this morning with a note on my car from the cop saying "Call me or I'll get a warrent for reckless and eluding"

Great.

*Update* Alright, I called my friend that got pulled over this morning, and he told me that the cop already knew it was me when they pulled him over because he was following us for a few mintues, and got suspicious since we were driving side by side and apparently he got our plates before we even started picking up the speed. So basically they just looked up my info and found me at my house. So basically, evidence of it being me is pretty damning. Also, about the drinking, I'm 21 now so having a few drinks wouldn't have been illegal, I wasn't even tipsy. Anyways, After finding out that the cops knew it was me, I figured I might as well take the responsibility and try and get off as easily as possible, so I called the cop just now, and the receptionist said he was gone until monday, and I could leave him a message, so I did.

The problem now: Let's say he doesn't get in until Monday. Then will he charge me with an offense that he saw me do almost a week earlier? I mean how is he going to give me a ticket a week after the events occured, considering the fact that he never pulled me over, or flashed his lights at me, so as far as I'm concerned, I never saw this cop other than this note he left me? In my message to him I didn't admit anything, I just said I want to meet with him to talk." I mean this is the same as you getting a note on your car from a cop saying, "You were speeding last week, I was behind you but I didn't pull you over, but I'm going to give you a ticket now that I found you."

He apparently has evidence on me so I can't deny it wasn't me, but can I do anything about the fact that he never pulled me over at the time of the offense and can't give me a ticket until almost a week after this all happened?

*Final Update*

Alright, I just waited out the weekend, and I got no call from the cop, so I'm all like sweet. Monday night I come home and my dad (he knows all about this now) asks if the cop called, and I say nope, and he goes, well he called me. O_O I'm like what the hell, what did he say, and apparently the cop was like "I can't do anything about it any more, but I just want to let you know that I'm gonna look out for him and if it happens again, he won't be lucky next time, blah blah.

So I avoided a ~2,000 dollar ticket (I live in VA, with the new fines) I avoided points on my license, and my friend got screwed.

In conclusion, I'm never going to do anything ricer related, revving or anything anymore (or for a while), but all in all, I have a pretty good cop story to follow my 21st birthday.

GET A LAWYER. get a lawyer now. Then, tell the cops, "anything you want to ask me can be directed through my attorney". Make sure your friend who got busted gets an attorney right away too.

DO NOT believe the cops when they tell you;

"your buddy gave you up - he's going to get probation and you're going to jail"
"we got witnesses who saw you do something bad"
"we don't need your statement to make our case"
"we're just trying to get your side of the story"

Don't people watch ANY cop shows? (other than COPS which doesn't show too much interrogation)

LOL, Dude, i've never heard that happening before!!!! At least he didn't pull you over and charge you with a dui. LOL. You could probably get out of whatever ticket you got pretty easily. Dude thats insane, you should definitely fight it. But thats so funny!!! Really sucks though, sorrry to hear that man.

Technically messing around like that is illegal... so the cop is right.

Now if he should've gone to that length, probably not, but they do what they have to do to protect the public.

That sucks, get a lawyer.. the cops are prolly too far away from you that they were not able to pull you over, follow you before you got home or even get close enough for you to notice them.. As I imagine it, they're too far away, not even close to say that hey I saw you in your car doing something illegal.. And you're already parked and they werent able to follow you close enough that they are sure they're not following a look a like vehicle.. Unless they got your plate the moment the cop saw you and your friend, but I doubt it..

So call him and tell him "your side". Driving around (as you say you did) was not illegal in itself...except for the drinking part. But theres no way he can prove that, unless there are opened bottles in your car (which were in plain view)... and has something else to go off of. My advice...tell him what happened, but dont mention the drinking part.

The problem is the OP already called and left a message for the cop, which could easily be construed as acknowledging receipt of the note.

I'm going to echo the get a lawyer bit if the cop gives you a ticket. There's really no way that they can get you for DUI, as they didn't get a breath test and there is no field sobriety test. This whole thing sounds odd.

There's no way they can get a positive ID from behind you. He's just trying to bait you into admission of guilt. You have the right to remain silent! It's the most important right we have, when it comes to these matters.

But hoefully your buddy didn't give away your info and/or say anything stupid...

Even so, it will be his word against yours. Using the "it wasn't me" defense will be critical, as nobody saw you exit the car nor did they confirm your identity.

Assuming that the cop never saw your face and that nobody (including you) said anything stupid, I would tell the cop to back off and never call again, or you would press charges for haressment.

Total and complete BS. By calling them and admitting to anything you will become the laughing joke of the department for years to come. Beleive me if you were wreckless and evading the would have got you....not left a note on your car. Oh and by the way what kind of note...like scrawled on a piece of paper? Yeah, no, I think you are fine.

It was on a business card. And I'm thinking maybe I should wait til they actually find me to make any action. I am not required to pick up the phone am I? I didn't admit to anything on the message I left, I just said I was returning his call as per his request. I mean I don't think he can arrest me for eluding the police when he never pursued me other than this note, so as far as I'm concerned, I don't even know what the note is regarding.

Now that I think it over, should I ignore his calls until he comes to my door? I don't think it's considered eluding the cops if I made the effort to call him and see what's up.

i beleive that will get kicked out easily. there is a cop in my old hometown that kids would drive by blaring their stereos when he was off duty to ____ him off since he was the one who got the law in that town and would enforce when on duty (well look for kids with stereos). and he would try to write tickets the next day if he knew who they were. but they said that was unlawful and they always got kicked out. so even if its like 2 days late you can get it kicked out easily.

I dont see how he can PROOVE it was you behind the wheel. Unless you admit that I dont think he has a case, since anyone could have been driving your car.

If he calls, sure answer it, shows you have nothing to hide. Don't offer any information if he asks you questions just don't answer them if you dont feel comfortable. Just respond with..."My apologies sir I have no idea what you are talking about".

He will try to get you to talk and offer up info. Doesn't really sound like you were doing anything that really warrants the severe actions he is stating.

if they wanted you are you trully broke some low they would have had you. if you had enuff time to get home park you car get in your home. They where not looking for you. how could you running for them if you never saw them behind you to pull you over. if i was you i would just call them and ask them what that note about. if you where speeding why not leave the ticket on your window instead of a note.

and that story is funny ... either the cops in your town ar dump asses .. or your friend it playing a joke on you .
