Making the TRD intake legal in CA? UPDATE
I'm curious as to see how many people are interesting in having the TRD intake legal in CA. The TRD cold air intake (part number: PTR03-21070) already is CARB legal, but it seems there was some sort of error, so I'm fighting CARB to allow it as they originally proclaimed.
However, I was recently informed that the Executive Order mentioned above (D-425-21) is incorrect. The TRD intake for the tC is supposedly not legal. The State of California Air Resources Board, in an official state document, confirmed the legality of the TRD cold air intake for the 2007/2008 Scion tC and I strongly believe they uphold their official authorization. This kind of technical mistake is not acceptable as it affects every tC owner with the TRD cold air intake and creates the illusion of the intake being legal in the state of California, when in fact, it is not. Annette Herbert, Chief Mobile Source Operations Division, signed EO D-425-21, which stated that the TRD cold air intake for the 2007/2008 Scion tC and 2008 Scion xB was legal and I believe it is in CARB’s duty to uphold that. I believe they need to step forward and admit their error (instead of not saying anything) and allow the EO to rightfully include the Scion tC intake as it originally proclaimed. It is not acceptable for a official government order to say one thing, but change their mind or find an error in their documentation. If they sign something and make it legal, it should be legal. No ifs, ands, or buts.

(Even if you have a 2007 tC, the TRD intake is still legal because the 2008 shares the same air sensor changes that began on the 2007 model year. A simple comparison of part numbers shows that PTR03-21070 is the same part number for the TRD intake on both the 2007 and 2008 year tC's.)

I sent an email to Rose Castro who then notified me of an update. There is update to EO D-425-21 titled D-425-25 in which a TRD cold air intake for the 2008/2009 Scion tC is CARB legal! TRD just has yet to release it to the public. The redesigned intake will probably be similar to that of the one currently out for the xB. More information to follow.

That executive order is for the 2008 Scion xB TRD Cold Air Intake only. They originally had mistaken that the tC used the same intake which in fact it does not. So the tC's TRD intake is not CARB legal, only the 2008 xB TRD intake is.
I am well aware of that, since you told me earlier. I'm saying that it isn't right for them to say it's legal in an official document and then say there was an error in the document. If they sign the declaration saying it's legal, it should be legal regardless of error or not. The least they could've done was release a amendment or recall the EO, neither of which they did. If the original order said it's legal and they did nothing to change that after they realized the error, it's still legal.
You may have me confused with someone else as I've never talked to you. :-) But if you can get them to honor it then great, I'm just saying what they have already told us. Good luck.
I checked that site again and noticed that you can contact someone from there directly. Have you tried that? It may be quicker than trying to start a petition of some sort. http://www.arb.ca.gov/html/eo.htm. Looks like the name is Rose and you can click on the name and send that person an email. Worth a shot I guess.

I was reading the EO's and I just realized there's no part numbers on these things. The EO's are incredibly vague and just say, "TRD cold air intake". That could be any TRD intake. There's nothing stopping me and other people from buying the TRD intake and just printing out the EO's and using them as excuses to get out of tickets and stuff. Also, the state of California can't recall the EO's and reformat them, only the manufacturer of the part can. So, one could say the TRD cold air intake for 2007+ tC's are all CARB legal.
I'm really sorry to bring this thread back from the dead....like really dead, but I went to TRDSparks.com to get pricing on the TRD CAI, and it states in all bold NOT CARB LEGAL. I drive a 2006 tC...so am I going to have an issue or are TRDSparks just a little behind in being informed of their legality. I always thought it was outrageous that a dealership could legally sell you something illegal...and charge you to install it to boot!
