Default Police Report

As some of you guys know, my scion tc got sideswiped by a honda pilot recently. I woud lik eto know what this police report is in favor of? I hope this doesnt have any effect on my claim on insurance. I wouldnt want my points to go up cause of some idiotic rushing driver. Thanks


"Vehicle 1 was traveling west bound on bath ave behind vehicle 2(thats me) who was traveling west bound on bath. Vehicle 2 states he stopped his vehicle because of a double parked vehicle and vehicle 1 passes vehicle 2 crossing a double yellow line. vehicle 1 states the same."

It favors you. You can't cross a double yellow, that's the law. Vehicle 1 is at fault.

watch out if you live in cali, no matter if your at fault if your insurance pays any money, they increase your policy, it sucks thats what the did to me, i was rear ended by a drunk driver, and he had no insurance, it totalled my truck, because my company paid my car out, the rates went up allmost twice as much, i was paying 84 a month now its 165, im trying to look this law up but they say it is in the books, i cant find this,

wow.... i could only dream of an isurance payment of 165..... 19 yr old male, no violations or accidentents.... 365/month

Most of the time Even if your not a fault the accident still goes on your record. It's up to your individual insurance company weather your rates go up or not. Some count an accident as an accident some only count at fault. Either way pay attention to your rate you might end up shopping come new policy time

Some ins companies in NY play games with percentages.
it is never a full 100% that one party is wrong.
vehicle 1 could be 80% at fault and pay 80% of the damage. that would mean veh.2 is 20% at fault and liable for 20% of the damages (all hypothetacal...but it happens...)
