i am in the deepest doo doo of my life... i got into an accident today... =(
my tc.. gone.. oh man.. and the worst part is i don't even know who's fault it was!...
i remember.. i had to take a left.. and i approached the turn slowly.. and stopped. and i thought it was clear, so i started turning so then a passat zooms in and i hit him on the left fender, and he hits a street lamp which falls over onto his windshield.. sadly.. i think i am at fault.. =( i don't know what i am going to do.. guys.. i just dunno..

Alrighties guys.. the car is home at my parking lot now.. and that means pics...

If you were turning left and the passat came up from your right side, in theory, you didn't yield for him to pass you. Your fault.
However, if you were turning with enough time and they came like a bullet, there should be enough skid marks to say otherwise. If they skidded or drove with enough speed to cross over and hit the lightpole, that could be it. Their fault.
Either way, too bad about yer tC. Hope everyone's ok tho.

Yup, sorry to hear about your tC. But like AKgoalie7 said, your insurance will take care of it so no worries there.

Ya sorry to hear that. Sadly failure to yield means just that no matter how fast they were going

I looked like it's your fault... No matter how fast the other car is, it's irrelevent, you are responsible to awear the traffic in front of you... similar theory can be applied in tailgate accidents, the car behind almost always at fault...

To make you feel better, I had a simiar accident (i was more like the passat thought, going straight), and hit a car turning left out of a T section. The cop said it was my fault though...

Unfortunately, I agree with bigmouth. You should've yielded.. cuz it looks like you cut him off too quickly.
Unless you can prove (skid marks, collision impact, etc.) that he was going blazingly fast (2-3 times the limit) and you didn't see him in the distance.. hey, you might be right.. but you could've been dead right.

Yeah the only time that wouldn't be your fault is if you had a green arrow and he ran a red light. But that isn't the case so...

it's only your fault unless he was going an EXCESSIVE speed, which if the roads are wet...could fall under the necessary and proper clause.

The police should do an investigation of it, and determine his speed. Only problem is, they prolly didn't have any skid marks to go off of.

Not to mention, in NV, it's the last person who is able to avoid the accident...they are at fault if they don't do anything to avoid it. There might be something on the books that say that where you are. Read up on your laws.

From what I understand of the law, it depends a lot on who hit who. If the driver hit you, regardless of what they were doing, they may be held liable since they are supposed to drive a safe speed (or enough so to stop in case an obstacle gets in their way suddenly). I'm not really sure about all this, so I'd definitely talk to a lawyer or your insurance agency about all this.

Sorry to hear about your accident. I'm sure things'll work out.
