Ok, time for a reality check. I don't mean to be a a dick. Really, I don't. But there is a major problem with your story. You say that you stopped, then proceeded with caution to make your turn and hit the Passat as he zoomed by in the opposing lane. But come on, man. The damage on your car clearly indicates that you hit someone/something straight-on (you went straight into his fender, pushing him into the light pole) at a much higher speed than that story would allow, and with significant FORWARD momentum. To get that kind of damage, your vehicle had to have at least 25mph of forward momentum pushed into his fender. A few miles an hour, like you suggest, just wouldn't do that kind of damage. Which means that you did not properly make sure that the way was clear before turning and that you were going too fast to do so. Also, wet roads do NOT mean that you won't get any skid marks. Based on that, I'd say that the police officer was right in finding you at fault after the field investigation.
That said, I feel bad for you and I hope that your insurance company picks up the tab for everything. I also hope that you'll drive a little safer in the future. Good luck!

Fahrenheit's said it. The pics look like you hit someone more head on, but, IMO, looks like your tC was halfway in the other lane anyway - looks like they mostly hit your right side.

I was making a left-hand turn at a green light in my old car. It was raining hard, and I was being extremely careful, since I had only a green light and not an arrow... Anyway, 3/4 of the way through my turn, this grey Saturn comes screaming off the freeway offramp at the next intersection, and clips my bumper as he blazes through the green light.
I had absolutely no time to do anything but slam on my brakes. Of course the guy jumps out, and starts screaming that I 'ran a red light' or some bull.
I flagged down a cop, we were seperated to tell our sides of the story, and an hour later the cop comes back to tell me:
1. The guy had a suspended license and no insurance
2. I was at fault for 'failing to yeild.'
He then proceded to let the man drive his Saturn away--which now had a baseball-sized chunk missing from a rear fender--and then wrote me a ticket.
I went to court, fought the citation, and lost. If the other shmuck had been 19 at the time, and I had been 40-something, I doubt the cop would have found in his favor, especially with the suspended license.
The only consolation I have from that is that some old jerk is driving around in his ugly saturn with a chunk missing from it's back fender.
Sorry about the car--your insurance should cover it. Look at it this way, you're getting a brand new car, all over again!
