Police never indicate fault when it is contested. They will provide the statements that are given at the scene. This accident report will likely do you no good.

Red light accident claims were the worst for me. As an adjuster you are obligated to take the word of your insured. If no one admits to running it then each company will say the other driver was at fault. It sucked because several times I KNEW my guy ran the light, but there was nothing I could do. So, expect her adjuster to find you at fault.

I hate that witnesses will not stand up and do the right thing. Getting involved means you talk to an adjuster or a cop and tell them what happened. It is not a big deal and you know you would want someone else to do it for you. I never understood the hessitance.

So, in short, what I predict will happen is both insurance companies will say the other driver is at fault and it will then go to arbitration (if LA is an Arb state) where a pannel of independent people will look at all the facts and make a judgement call.
So you need to tell your adjuster every bit of detail you can to make sure you have the best case and clearest story when it comes to that point.

Also, open a claim with your insurance company if you haven't already. You need to get the process started.

alright i just talked to my dad (he is handling everything since ive got so much crap going on at school). He talked to my insurance agent and they said that neither one of us are at fault so we hired a pretty big named attorney (family friend/ ex next door neighbor) to handle it.

The work order was sent in for my car and its going to be about a month before its fixed. The body shop that is working on it is supposed to be the most reputable shop in AL (thank God). The owner of the shop said that the lady that hit me must have been going twice my speed (this reaffirms my belief)

My girlfriend is going to the shop soon to take pictures for me so those will be up when i get them.

Thanks for all the support and helpful information guys.

The at fault thing is bothering me. The person that hit my car told their insurance that they were at fault since my report didn't list who was. I hope the shop you have does an excellent job on your car. I took a look at mine yesterday and the driver's taillight at the top corner and the quarter panel that should meet up to it has a bigger gap after than even when the car got hit. I'm still waiting to see what the shop is gonna do(they said they'd try to adjust the taillight).
