Default XB totalled in wreck - selling parts

hey guys, the sad day has arrived. my toaster died. the drunk lady driving the frontier never even saw us. nevertheless i am selling some aftermarket stuff to cover my deductible.
moon hubs, sport pedals, diamond plate floor mats, original hub caps

If the lady who hit you was drunk, then the collision is not your fault, so why do you have to pay a deductible? Is your insurance company saying the collision was your fault? Or is there something I missing here?

First: I took the Baby moons. Thanks, Joel.

Second: When you get into an accident, regardless of fault your own insurance company covers your loss -- after you pay your deductible. Eventually, after your insurance company recovers its loss through subrogation (that is, collecting the loss from the "at fault" party) your insurer will pay you your deductible. Sometimes, it can take years of wrangling in the courts to determine fault and get that deductible back! Fortunately, that's your insurer's job (and cost), and its mostly their money at stake.

EDIT: I speak for Pennsylvania law, the above probably applies in general to most states.

As I said before, his insurance company handles that. His insurance pays his damages up front so that he doesn't have to wait for the other party to be proven at-fault. If his insurance company can't collect, the most he has at risk is his deductible. Also, all of the costs of recovering the other party's damages (court costs, investigative fees, attorney's fees, etc.) are borne by his insurer.

I believe that in many states, you can retain the right to sue the other party directly IF you decline your insurance company's coverage. However, this is generally not considered wise (for reasons spelled out above).

If you accept your insurer's check, you then give your insurer the right to pursue collection of your damages on your behalf, and for the insurer to retain the proceeds (minus your deductible, and not to exceed your coverage limits). This is called the insurer's "Right to Subrogation".

Again, this applies in Pennsylvania, and possibly many other states.

Joel - just to let you and the others know, the hubcaps arrived perfectly.

Glad you were not hurt, but don't sign off on anything. Just in case. I have to go to court to testify in a drunk driving wreck I witnessed, of she had to get an attorney. Are the pedals available? I have a automatic and need silver ones.
