Yeah, the 'no waiting period' in Virginia does raise my eyebrows, too.

Here in Washington state the 'normal' waiting period is 5 days for a person who has been a resident of the state at least 90 days, and who has a valid permanent state ID or driver's license. The local law enforcement has 72 hours to do a complete national and local records check, and must also check mental health records, before the firearm can be released. (If all those cannot be met, there is up to a 60 day waiting period.) HOWEVER, if the person has a valid concealed carry permit from this state, there is no waiting period.

Different states have different requirements.

In Texas, they call the FBI and check your record while you purchase the gun. They can deny your purchase, or they can give you a "hold", especially if you have purchased a firearm recently. If you have a carry permit, they do not call the FBI, because of the cleanlieness of your record to recieve and keep the permit.

In Washington State that would have been enough for him to have been rejected by the normal REQUIRED screening process, and prevented from legally buying/carrying weapons here until and unless he was subsequently cleared by the mental health folks (and in this case, by the court, since it was an involuntary commitment).

I do not know what the laws in Virginia require.

Washington state firearms laws:
http://apps.leg.wa.gov/RCW/default.a...9.41&full=true

From the RCW:
A person is not allowed to own, posses, or control any firearm:
"(ii) After having previously been involuntarily committed for mental health treatment under RCW 71.05.320, *71.34.090, chapter 10.77 RCW, or equivalent statutes of another jurisdiction, unless his or her right to possess a firearm has been restored as provided in RCW 9.41.047;"

Tom
It is quite disturbing that he wasn't flagged. It would have kept him from buying a firearm legally in Texas as well. This changes the whole story, and this should quiet the people up that acted like he was a normal, mentally healthy individual. This just proves that people suffering from mental illness shouldn't own firearms. This could also un-cover a flaw in Virginia's laws.

I hate to break it to you Californians, but the 10 day waiting period is almost completely a California thing. Your Govt. expends a lot of energy making it hard for you to protect yourselves. Personally, If I lived anywhere near the gang activity in parts of California, I would consider a firearm an important ally.

Of course, this is a very conservative (not a supporter of the Republican party though) Texan's view on the subject. I am not trying to start a fight on here, but that is pretty much how most firearm-friendly people I know view the laws in California. Just remember, a murderer buying a gun illegally doesn't have to wait 10 days, he just buys one off the black market.
gangs have not run rampant in cali since the early to mid 90's...... people are not crips and bloods anymore. some still claim it but folks aren;t out killing over territory anymore and have not in a LONG time.

Wow... cali is FULL of gang activity, not sure where anyone got the idea it wasnt. Maybe the crips and bloods are not as big, but that is only because others have taken thier place. The MS13 is the worst gang around in the US right now and is all over cali.

You're right, but considering that nobody in the Crips or Bloods ever bought a gun legally, I'd look elsewhere for correlation of the dramatic decrease in gang activity in Cali. There are several other legitimate possibilities.

Wow...hows life under that rock?

Having lived in California all my life, I can attest that gangs are not roaming the streets looking for victims. Sure, there are a few bad neighborhodds, but that is the case with EVERY city I have ever been in, which number in the hundreds.

Kindly pull your head out of your a*s sir.

I live and work in east LA... This area IS full of gangs. They aren't everywhere, but where they do exist, they exist in high concentration.

I know the difference. Statistics incorporate an entire ehion and do not account for dispersion or concentration, and I was attempting to point that out.

uh-huh:

Even as Los Angeles' decrease contrasts with the national trend of rising crime rates, statistics show that the city still contends with high levels of gang-related violence. There was a 14% increase in such activity in 2006, said Bratton. Last week, after the press conference, Villaraigosa flew to Washington, D.C., where he met with United States Attorney General Alberto Gonzales about efforts to reduce gang violence.

And you're saying there aren't a bunch insane liberals in Cali? Home of the 9th Circuit Court of Appeals?

We've all got our fair share of freaks tho. Even places that are full of non-dysfunctional Beaver Cleaver type families are even a freaky. So normal it's freaky!

And I'll take stuck up old people over the crotchey old farts that complain about a $.99 cheeseburger when they're sitting on 2 mil in the bank, and who drive like the whole world is a school zone.
