i think kennon has a point though. At least its true in minnesota.

any hit from the rear, the rear persons at fault. even if youre in reverse.

its actually kind of stupid because there are some circumstances sometimes that ruins things for people. but in your case, you're good

You win the case once you provide those pictures. The judge will notice that you were backing up, in the right spot, which backs up your story. Once he sees that tuff guy is in the crosswalk he will automatically tell you that you have won the case.

No idea what the firearms laws are like in CA, but if their anything like AZ you should really invest in a hand gun to carry if you are afraid of confrontation with people. Paul walker* there would be more polite if you had a belt holstered glock in plain sight.

I plan on getting myself a handgun soon, too many people in AZ have them, I feel left out.

Anyway, hes at fault. That is a crosswalk for people to get to their cars in the parking lot - not a thru way for honduur owners.

im also going out of a limb and saying its his fault since they should have been paying attention to the ____ in front of him.

the blind spot on the tC is killer...

If you live in the Bay Area or L.A. and tried what you mention, you will get shot. (Just like 'Boyz N the Hood'.)
Not a smart idea. Too many "wanna-be thugs" carry guns in Cali. Is your life really worth dying for over a
parking spot? I think not.

Him paying attention in the front is not even the case anymore. The more I see the picture (specially the 2nd one) the more I believe that he hit me purposely.

But anyways, I don't want any violence involved in this. Its just a car, but I hate how irresposible he is for his action. Again, you guys are the judge, I'm not pointing fingers.

Thats pretty true, there are crazies in Cali. I've been to hard areas of NY, but they seemed smarter there. More business like. lol

if u mean by "guns" i hope u mean his muscles and all... but unfortunately its this guys' fault... he may have all the muscle but he has no brain... no brain as in, its not a parking spot kinda no brain deal... and i believe he was cutting through there to take the spot you were about to take. u have pictures, and thats a good evidence of the situation. good luck

Typically whenever there is a parking lot accident and someone is backing, the person backing is found to be at fault. If both are backing, liability is 50/50. These pictures tell the story, and your adjuster should take one look and find the other guy at fault. But rest assured the adjuster for the other guy may find you at fault. That's just how the game works.
In private parking lots, there are generally no laws that govern how you drive. As long as you aren't being reckless, you can't be charged with anything by the police.

I don't know the CA insurance regulations or even what type of liability they work under, or I would be able to offer more advice.

I'm sure the other guy is some kind of arrogant, aggressive jerk. Anyone else would have gotten out and told you how sorry they were for hitting you.

I'm sure there is a law that says you can't drive through a pedestrian crosswalk like that somewhere. I'm pretty sure driving through a pedestrian area like that could be considered reckless driving.

the only thing that you could have possibly been dooing wrong that i see is going the wrong way down that particular row of spots, since they seem to be canted for cars going the other way. but still totaly his fault.

Hmmm....

He's driving forward into a crosswalk, you are backing into a parking space, but also in the crosswalk...

In almost every state parking lot incidents are considered "No Fault", this is a prime example of why. The better question is, who was more wrong... This is a No Fault accident, you both should pay your own losses....
