Why wont it just die
You should tell your insurance agent that if they don’t total it and cut you a check, that you will be switching insurance once your case is settled.
Can’t you just take the money that they do give you and not fix the car? With that much damage, it won’t be worth as much as it cost to fix it once it’s done. Just part it out and either sell the parts or keep them if you get the same car.

My parents use to have a 92 Chevy cavalier wagon and it was hit in the side,only $3K worth of damag and the insuruance company totaled it. My parents had to force them to fix it and not total it, they only had the car 6 months and didn't want to get a new.
Maybe you could escalate it to someone higher up in the insuruance company. My mom has contacted the president of my insuruance company before, after a good chewing out over the phone we got what we wanted, which was not to be screwed over by company we pay to take care of us (ya right).
