Dude that sucks. What sucks more is how hard / expensive it is to get money out of an uninsured motorist. Did the police impound his car for no insurance? Best of luck with your insurance company.

sue him since he doesn't have insurance. how the hell do you drive around with no insurance? isn't that the same as driving without a license? if you sue, you'll win it all.

It's not as easy as it seems. Sure you'll win in court, but getting the person to pay is the hard part. If they don't pay, you have to file for wage garnishment (which isn't cheap). It just gets more complicated from there.

Someone in a Cadillac with no ins. hit my Acura. I've never seen a penny from him.

this is the 2nd time i've seen a tC lost to someone without insurance.

it baffles me that people get away with it.

From the view I got that is repairable (work in a body shop), I know this will sound wierd, but I hope there is more damage somewhere else.

From what I can see...

Quarter Panel, Tailight, 3rd Brake Light, Bumper Reinforcement, Bumper Absorber, All the clips, they won't repaint the whole car, they will simply blend from wherever they can put the quarter panel on. i.e, once they're in an area not damaged they will cut and attach a new piece. The hatch lid, the bottom, and inside of the trunk under the interior panel might still need replacement, as well as the wiring harness for the lights if they got damaged. Like I said, if I could see more I could give ya an idea of what it would cost. I got the Scion tC crash book at work.

The biggest factor is frame damage. If that's damaged, the car should be as good as totaled.

I sideswiped a telephone pole (don't drink & drive, if you do, don't fall asleep) back in 2001. The passenger side took all the damage. The door, front fender and rear quarter panel were done including the front suspension (ripped a wheel off). Although the damage looked bad it was the presence of frame damage that "luckily" caused them to total it.

Sadly, I think DelayedTurbo is right, it looks like they'll opt to fix it. Pray for frame damage.
Has a shop looked it over yet?

I know in CA if you get into an accident without insurance (even if it's not your fault) you get your license suspended.

I have uninsured motorist on my policy, so i am going to be covered by my insurance 100% and then they will sue the guy that hit me. I'm not sure if they will fix it or not as of now. I had a shop look at it and so far the estimate is at $6200, but add that on to the diminished value that i am trying to get and it is right on the line. There isn't any suspension or frame damage. The alignment isn't even off by much. I drove it today to get the estimate and you couldn't even tell it is damaged except that there is more road noise thanks to the hole in the trunk floor. So if they fix it i am okay with it. I already got a really good shop to agree to do it for me if they need to, and i would walk away with a pocket full of cash. If they total it, i get a new car again! Either way, my passengers and i are both okay, and i still have a tC, so it can't be all that bad.
