Default Rear Ended

Well someone rear ended my car while I was at a dead stop. The damage is minimal just a few dents and marks, but the problem is the only way to fix it, is to get a new bumper....

Well think of the HOURS it would take them to Fix your bumper , then sand it , paint it with a primer then the final coat . That would be A LOT of $$$$$$$ in Man Hours @ probably $60-$75 an hour .

It is cheaper to get a new one , take off the old , put on the new one and paint it .

I had damage to my front end ( Pic in Profile ) Im not sure about tc , but the xB`s parts had to come from JAPAN , No parts here . My car was gone 2.5 months !

If someone rear ended you - their insurance should be paying for it, you shouldn't have to worry about it. Was a police report filed? Insurance companies called?

I didin't file a police report. She just wrote down all her information: her name, phone # , adress, and all her insurance information. I rather not go through insurance companies thats why I didn't call the cops. I'll just call her at her house and let her know whats going on.

I tried that once too... someone rear ended me. He ended up screwing me and I took him to court and he had a lawyer and they just lied through their teeth about the whole incident.

I ended up having about $1700 in damage (on one of my previous vehicles).

ALWAYS, ALWAYS, ALWAYS call the cops, take pictures, and call insurance companies.

You should try to keep a disposable camera with a pen and paper in your car at all times. Take pictures of the scene and the damage and what not.

Call your insurance company, before she "forgets" that she rear-ended you. It's too late to call the police.

Besides, the damage to the car might be minimal but you may start feeling sore in a few days.

If it wasn't your fault, why NOT get the insurance involved? That's why they have it. Hope you don't get screwed.

My dad doesn't want to even try to fix it, because he's afraid a new bumper won't fit as good and the color won't match.

Um... if a reputable body shop does the repair (that the other insurance company should pay for) - it should match. If not, you'd be able to take it back and have them replace it again.

Ok first off, I agree about calling the cops. That way the city or county also has record of the incident. Second...I would call their insurance company and see if you can get this taken care of with out involving your insurance company....just so you wont have to pay your deductable.

He shouldn't have to pay a deductible if it's deemed the other woman's fault whether or not his insurance is involved.

Unfortunately, by now, it's "he said - she said" stuff b/c there was no police report and probably no recorded witnesses.

Agreed. But in the case of a rear-ending at a stop light (sign, whatever) unless he put his car in reverse and floored it, I doubt any insurance claims adjuster would find him at fault or even partial fault. The insurance companies (both of them) will each do an independant investigation and will take pictures and statements from both parties. It may take a week or two but it should be pretty cut and dry.

I just got rear ended too, they damaged my rear bumper and the muffler. Came out to about 1.3k of damage. Took it to the dealership and let their insurance take care of it. Just got it back and the bumper matches perfectly.

Go take it to the DEALER ( No Im not one ) Because , they HAVE your EXACT COLOR MATCH . And the Dealer HAS TO DO THE JOB RIGHT , their Name is on it . I hate it when the INS. Co. says , " Well if you take it to one of the places I suggest , its insured to come out right "
What does the Dealer do ???? EXACTLY THE SAME THING , PLUS you know they have worked on your model before and have the Exact Paint match .
As for a Throw Away camara , Just make sure you change it and get a new one a few times a year , or one day when you NEED IT , it might Not Work .
I never leave without my Digital , You wont be sorry as long as you change your batteries often .

This is a good example why you should always bring a camera in your car. I had a parking lot accident a few years back when a guy backed into my car as he got out of his space. It was negligence in his part that he did not check his mirror to see me waiting in the parking aisle to get into another space. He tried to claim that I hit his car, even though he cannot explain how my car can travel sidewards into his rear bumper . Luckily, my cousin who was with me had a camera and took pictures of the cars before they were moved. I mailed copies of the pictures to his insurance (AAA) who were preparing to fight my claim per thier client's claim of innocense. The called me right away after getting the pictures and agreed to take full responsibility to get my car fixed! The pictures and the narrative I included to explain them cut the story short and got my car fixed on the other guys insurance policy.
I now have a phone/camera that will always be ready for such an occasion. I think it's worth the extra money when you get your phone because of this.
Good Luck with your car. I think you have nothing to lose if you try to calim against the other party, whether you're successful or not, so GO DO IT!
