1. You lose torque
2. I think they are trying to make it with the throttle body in the stock location as to allow for all the aftermarket CAI out there.

if you want your maximum boost at the middle range of engine operation, the tubes have to be longer for the wave to take more time to get out and back in sync with a intake valve opening to give maximum boost at 2800 rpm. If you want that engine to scream at 5000-5500 rpm, the passages have to be shorter as you want that wave to get out and come back quicker

What they need is an infinitely variable length runner system. . . I know they have variable length intakes, but I'm not sure which parts are being adjusted on those systems
^^^ Like the variable cylinder height SAAB came up with a few years back that GM tossed? It would take some engineering, but possible! Back in my karting days, we had ajustible exaust pipes for tuning high and low end power...
Why not make an intake that looks like stock but doesn't have the internal baffles? It will flow more freely, look nicer, and still use the intake systems in the market. OR create an intake that looks like stock but has longer runners, The 1NZ has torque, might as well build up on that, with some good 4-2-1 headers like you guys made this thing will have one thing Honda doesnt TORQUE!
I would love to know what torque numbers MMW got from that intake. It may have lost some on the mid and high end, but I would think that you could get some of that back with mid-high mods like headers and more free flowing exhaust.
