I never received a letter. Had I received one I would have definitely participated.

I got the lawsuit letter, and the crack, some years back and was really bummed to find out it only covered the '06. I waited so long.........

It would have been a larger lawsuit, protected more owners, and the firm could have made more money, if it could have covered the '05.
Yup.

That's basically what the firm told me after I wrote and called them some months back.

I remember you started a thread in '06 about this issue, I think. Mine wasn't cracked at the time, and then I chimed in here:

how long did it take to get a response from the first mailing to when they responded to you? I was denied a windshield replacement from the dealer so I sent off an appeal to the Bauer v. Toyota PO Box and have yet to hear any response from them. I sent that on the 8th of January.

dealer denied my windshield case too because there were rock chips as well. the original crack however was the one that be should covered under warranty. just started for no reason from the bottom center of the windshield. i just went and got it replaced myself from a local place and mailed the receipt from that with the paperwork that they sent me. probably got the check about 2 months later.

if i remember correctly, i signed up for the thing online. i dont remember mailing anything myself to initiate the process. but honestly, i don't really remember for sure.

k thanks for the info. Yeah I was denied (started from the bottom middle too and extended toward driver side) because they claimed it was from a rock. they used the pen test which in the settlement FORBIDS the dealer from using such a test. It appeared when I was slowing down at a stop sign. I mailed them again a few days ago because I never received anything in the mail, email, or telephone.

sadly, you might be out of luck as i think the date already passed to get in on the settlement. it only went for a certain amount of time.

"If you seek to have a cracked Genuine Toyota windshield replaced in a 2006 model-year Scion xB after the Effective Date of Settlement (August 24, 2010) and within the first six years or 60,000 miles of original retail sale or lease of the Class Vehicle (whichever comes first), you must present your Class Vehicle to an authorized Toyota dealership to determine whether your windshield qualifies for coverage under the Extended Warranty. If your Extended Warranty claim is denied, you may appeal the denial." <-- I just appealed my denial this month. Thats what I sent them.

My first windshield cracked one day right in front of my eyes, no chips or anything, think I had about 10,000 miles. Driving down the street and it split right in my vision spot. Guess I should have been following this and got a free replacement. I am on my second now and have about 6 chips in it.

I had a similar thing happen to me, but I was sitting in my xB in front of my work. Not even driving and mine started to crack right in front of me. My first one started cracking after the first week. I am now on my third. Oh and as far as this class action suit, I recieved my $270.00 check about 2 weeks ago. Good to get a little something back.

Mine cracked days after receiving it so there was very little mileage to claim for this. I got my check recently too
