Thank you to the drunk driver who totaled my car this mornin
Thanks for the support guys, I was pretty down in the dumps this morning but then started thinking about how much fun shopping for a new one will be, especially since im not paying for it. Even if it isn't totalled, I think I can still request that it not be fixed, I sure wouldn' t trust it in a rollover after they get it fixed up. Oh and I don't think he will be skipping town, ive done my research on this guy and could even tell you how much he paid in property taxes last year! Oh, and it was interesting that I found his chevy bowtie emblem in perfect condition laying under my slain vehicle and was wondering what to do with it. Ive ruled out giving it back to him, should i sell it? Any creative idea would be most appreciated. I was able to snap one more pic before the tow truck came. Its hard to see....i know.
I dont know a whole lot about totalling and insurance....but that thing has to be beyond repair...
When you say he stopped by, does that mean that his truck was still driveable? I would imagine that he would have been banged up, and his truck probably totalled as well...

Curiously, the impact momentarily flexed the truck frame upward so much that the top of the bed dented the rear of the cab, then the frame unflexed. The truck drove perfectly because the suspension and drive train were not affected. It was "totalled" only because its value was so low and equaled the estimate. I kept it and repaired it.
The truck that hit the xB in this post was probably perfectly driveable, especially if it was a full-size truck. Trucks are tough and xBs are unusually fragile.
His friend drove him back to my house, which is roughly 4 blocks away. That was 45 minutes after it happened by the way. I have to give the guy credit for that though, fessing up to it before I even knew anything happened. You can see the anti-freeze trail in one of the pics, it actually leads right to his driveway. My amatuer estimate on his new 1500 would be about $5000 i would guess. No apparent strucural and mostly cosmetics....bumper, grille, hood......the radiator is what will get him.
I hope he also got busted for driving intoxicated. Add that to leaving the scene of a hit and run. I think the guy will be paying for a loooong time.
My 3 year old son routinely rides in the back of my xB. Looking aththe driver's side rear seat, it looks like my boy could have been injured in a similar accident.
The moron who did this to your xB needs to be dealt with harshly so he won't go out and do it again,

Sorry to hear that. I know how it feels. I lost my BSP xb only 2 months old, and some retarted driver made a left turn without yeilding. I ran smack into him. I t was a ford ranger that I hit. The whole front end was totaled. The police sited the other driver and I made sure that his insurance paid for my box.
The wreck was estimated by the dealer's repair shop at $12359.00; at then my insurance adjusters declared totaled since its more thatn 3/4 of the value of the vehicle. Well it took about 3 months of hell to deal with the guy's insurance.
And since then they got me this TCM xb.

Those pics are just gross. I seen your post earlier before the pics. Just seen them now and my jaw dropped. I would be so bummed too if I came out to that. Where at in wisconsin are you?

Actually it is up to the ins. company, and I believe they usually go somewhere between 50 and 80% of the vehicle's value (not replacement cost)
it depends on the insurnace company of the driver responsible to see if it gets totaled. plus the xb is a unibody not on a frame i think.. easier to fix... from the looks of it.. i would think a lot of money would go into labor and not parts... i would say 65 percent of the cost of the vehicle is in the engine.. i would get a lawyer ne wayz because you know that thier insurance will give you crap about getting the value of the car and what you owe on it.. unless you have gap insurance.. but because it is not your fault.. their ins should pay for all of it... if it was me.. i would just get a lawyer..
I just wanted to cry for you when I saw the pictures. But on the more productive side, if you haven't done these things already, do so immediately:
1. If the car hasn't been towed yet,:
-- put the bowtie back under the car where you found it and take a picture of it there for future use. The pics of the broken glass and skid marks that you took are great and will go far.
-- Did his insurance company come out to take their own pictures? If they didn't, try to find out why.
-- If you haven't already, make sure you get a really clear, close picture of the skid marks where he clearly takes off after hitting the car. Hit & run and drunk driving, he's screwed -- make sure he's stays that way!!!!!
2. Contact your own insurance company, part of what you pay your premiums for is for them to sue on your behalf if need be. See if they will have one of their adjustors look at it to be sure that the other insurance company is being fair. Your insurer should partner with you to resolve this.
3. Remember that if you are not happy with what his insurance company settles, you can take him to civil court for what you believe to be correct. Civil cases are public record so if the guy doesn't want it spread around any more than necessary that he's been busted for drunk driving, he'll probably try to settle out of court.
I'm not sure if you could get a lawyer to sue for mental distress, but we'd all vouch for it if you did!
