An independent witness that says what? "uh yea, so dude was driving across a crosswalk and totally didn't hit that guy who was parking legally." Not terribly supportive of the other dude.

That crosswalk is actually a marked handicapped crosswalk designed & marked specifically as a warning to drivers in the parking lot for wheelchairs that might be crossing after exiting the handicapped parking spots on each side of the marked crossing. Just pray that if this one goes to court, you get a handicapped Judge... case closed, Acura owner guilty with a HUGE fine.
Plenty of blame to go around. Both cars are in the pedestrian walkway. If the silver car had tried not to shortcut into the space through the pedestrian walkway contact may not have occurred. If the black car had been properly within the space the contact may not have occurred.
Backing into a space is always more hazardous than going in frontwards and should be done very cautiously. I suspect that in a heated competition for this parking spot caution was forgotten and the driver of the car reversing didn't center the car properly in the space.
The question is, was "winning" this competition worth it?
Oh, and you could have gotten a better police response by stating that you were feeling threatened by the other driver. His appearance is clearly threatening and I have a feeling that his attitude was a match. You shouldn't have to deal with a gang-banger without backup to ensure your safety, and that _would_ justify the 911 call.

I won't post any update until the whole ordeal is done. But I think the guy who hit me comes in this website. So far its 60/40. Me being 40% at fault. However, an independent inspection shop today found out that my car was damaged by an incoming vehicle.
OK GUYS UPDATE: The other party's insurance finally caved in. The 60-40% me being 40% at fault is no more. I got the $200 deductible I paid for (40% of 500) in the mail. Cased closed. Thanks to everyone's support!

Note: In my experience, a guy in my parking lot at work (who is notorious for flying throught the lot) swung out of his spot and hit my car when I wasn't even backed up 3 feet. We stopped and exchanged insurances but neither of us turned it in, and decided we'd each handle our own.
The part that irritated me though, is he drives a Jaguar... he was on his phone, he has the sensors in back, and his bumper has like, 3 little dents, none larger than the size of a quarter.
Me? Yeah, crunched a chunk of my bumper - but didn't quite break the back passenger reflector. So now I have to buy a whole new bumper AND get it repainted.
Soooo I decided to call the PD and see what they said.
Apparently, it's the fault of whoever is backing out - so I told him we both were (which is true). They said that it was no fault in that case (this is true in a private and public lot). He said that unless I could prove he was driving recklessly, it was no-fault.
I thought about taking a few videos of him, but decided $250 isn't really worth going to court over.
Soooo just something to keep in mind. That's here in Iowa though...
