Default Need help from someone who works at dealership

Hey guys im in need of help. Basically right before xmas I traded my gas guzzler in for a Toyota Camry. My first mistake was taking it to Earnhardt Toyota, I only went to them because they were on my way home, and I had bought my Tundra from them when they were superstition springs.

So far its been a pretty big pain in the ___. When I first got it, I had only seen it at night, the next day i go to pick it up and its under bright lights I find a TON of scratches and marks on the body. I told them I wouldnt take it, and we agreed they would fix the hood/trunk. I get it home next day and have a detailer friend of mine go over it for a quick wash. He shows me right away how the bumper has been touched up very poorly and whatever they used to fill the spots was crumbling off, looking like the bumper was in a small fender bender. So now im really ____ed. They agreed to fix that, but acted like I was crazy for even asking.

So I pick it up other night on way home from work, hood and trunk look great, but bumper is still all messed up. Service was closed, so I took it home. Next day talk to service manager and he said he told them to do it, but they "forgot" to fix the bumper.. and to make another appointment.. fair enough he wants to fix it cool.

So tonight i get home from my Birthday diner, and the finance manager had left a message to call him asap. So I get ahold of him and he tells me that after some figureing out with the bank they have to REDO the loan... so i ask him how it effects me negatively, he said it doesnt.. that they just lower the price of the car for me to keep me at same payment, then after more probing questions.. I find out to stick at same payment they need $500 MORE down (already put down payment) and I would still LOSE the extendend warranty I already was told I would have and already went 30$ a month over my budget I had told them i wouldnt budge on.

So now im stuck.. I dont know what my rights are, over all im not willing to pay more per month, and im not willing to put down another $500 for somthing I thought was a done deal. I told them from the begining NOT to do this to me since I had it done to me on a VW Toureg i bought a few years ago, and got really Screwed on and they called me a month after i owned it and said I had to pay $100 more a month..and it was a pain too.

Btw im totally down for giving that car back and going to someone I can trust like one of the regulars on here. This just ruined my birthday night that was going so well.

Damn Ryan that sucks dude. Sorry to hear your having to deal with such a mess....and on your birthday too!!!

But J "earnhardtscion" might be able to help you out on this. He's the scion champion there. I'm not sure how much he/they get involved with toyota sales but maybe he'll be able to get something going for ya.

from my car buying and what i read about the deal is that you can get your money back and walk away from the car IF they dont get you the percent and payment at what you had when you drove the car home. i could be wrong but that is what i was told at the dealership i got a car from and from what i found online.if they say 300 a month at 99% then that is what you expect and if it differs at all you can opt out of the car.

If they do not have the financing fully worked out you can take the truck back anytime (tell them to stick it). I would have also taken the truck back with the damage and made them take it back. In Arizona when a loan is created you have 3 days to not accept the loan (I believe). That is why most morgage companies will not fund a loan for 3 days. But if they have not found a financial institution and the paperwork is not totally completed, make them take it back and contact the AZ attorney general about thier poor business practices. Besides, you shoule be buying a Scion.

yes I would agree Ryan, just tell them since they can't get the financing worked out that they need to take it back and give you back your down payment.

Either talk to J in the Scion department OR go talk to Bryan at Camelback who works in the Used car department as a manager OR talk to Chad in the Scion department and you'll be well taken care of.

If that dealership is trying to change the original loan you agreed upon then I would say the original contract is null and void and they're going to have to take the car back. This is just one of the things I've heard of an Earnhardts dealership pulling on people which would discourage me from every buying from an Earnhardt dealership.

The event that J at for us at his dealership was great and I know we all appreciate the support that he is trying to give to the Scion community. J is going to have a big uphill battle though trying to restore any kind of good image for Earnhardt for a lot of people. The only thing J has on his side at this point is that the Scion department is different.

yeah really I should have taken my business to either camelback or avondale being that they have a great rep for taking care of people. Like I said I bought the truck from there and it was super easy. Looks like earnhardt taking over changed things.

definitly take it back, if the contract was not finished properly, then they can shove it. I HATE dealers that pull this crap. They do it to a lot of my friends and I have to go get it all straight for them. Earnhardt specifically did this to a buddy of mine as well when he bought his SRT4. Not the superstition springs location, but I was amazed at how shady they were and the level of crap they pulled.

Yeah Garage, im now hearing from multiple people, even one that worked at an Earnhardt that this is standard practice.

Go to your own bank to get the loan! The rates are generally lower because the F&I manager is holding between 1 to 3% as their own profit. Most dealerships make more money from the financing than the vehicle profit. The reason they are reducing the purchase price is probably because its well above the (LTV) loan to value. Without going into more boring details, good luck to ya.

Three day right of recision does not apply to automotive financing unless in your case the financing isnt secure. Generally as soon as you drive the car off the property your an owner. Its an extremely common situation your in. Best of luck on getting it resolved.


oh yea...Dont buy the Service Contract aka Extended Warranty but do get GAP. Im a big time fan of GAP.

Yeah man, it is very sad. I really like the J guy over at that location and they did a HECK of a good job for toys and such at christmas and I support the scion part of the dealership as he is a good guy.

We had a lot of our scion members not attend actually that would normally go becuase of issues with earnhardt in the past, with the friends and family being hosed. I myself almost did not attend but the wife said "it's for the kids so lets have a good time" and we had a very good time. Just sucks there are so many VERY shady deals and shady / evil practices that go on with that company as a whole. Sickening.

I'm surprised honestly how Earnhardts can stick around for so long still even though almost every person that lives in the valley knows someone with a horror story from them if not their own.

Most of the finance guys are jerks. The talk out there A$$ to get you to do upgrades and crap like that.

update,
I got approved for loan thru my credit union, Basically found out exactly what he had me out the door. After about an hour of talking I got him to drop the price out the door by about $3000 and not to mention my rate thru credit union was much better, so over all this was a blessing in disguise. I saved myself over $45 a month, from what original deal was and got everything exactly the way i wanted.

Were waiting till monday for my credit union to give final OK but im pretty sure its a done deal.

HUGE thanks to Chris over at avondale for having one of his finance guys help me, also would like to thank Chad for the help also. Im really smacking myself for not originally going to a trusted dealer, also I should have just gotten the TC I have been wanting but overall looks like it will work out.

Thanks again to all that helped
