I'm so sorry to hear this. I know the feeling my 1st gen was backed into twice. When you put so much work into your ride it just makes you sick when people are so careless. (though this guys seems a little beyond careless.) Hope the repairs go smooth and your back on the road soon.

What would be awesome and I meen AWSOME.......we all line up out side the jail the day he gets released........nothing more.........just a great big showing of Scions.......bet he ____es down his leg......

For anyone interested. preliminary investigation is showing that there is NO structural damage. Just Body damage.
Tommorrow , Special Interest Autobody will start taking her apart. baring any unforseen surprises, this means other than my small deductible, everything will be covered. My TRD CAI was destroyed, but my header and exhaust look untouched. as does the rest of the engine. YAY. Actually, my adjuster told me that anything under the hood was automatically covered. :D But I RELIGIOUSLY saved all my receipts, and will be faxing him copies for all addons I have done.

Hate to see a hurt Scion.

The aggressive idiot who caused the accident and then assaulted you not only need to be in jail for a fairly long stay.

Shouldn't HIS insurance (if any) be paying for your repairs? If he has no insurance, he should be paying for it personally (let your insurance worry about that). In any case, I din't se why you would have any deductible to pay.

Glad to see you are all right, but do be sure to verify that since he did assault you. (And Road Rage is a good call - try to get the prosecutor to go with that.)

Lastly, it is a good thing he didn't assault someone who was armed. If it were me, I'd have 'been in fear for my life' and would probably have put three in his lower abdomen before pausing to see if he were still interested in his attack...

I agree Tomas. the deductible is for this reason. Because farmers realizes I want my car back, and they KNOW it's not my fault. Farmers is going to pay to get my car done first. THEN they are going to aggressively (thier words) go get thier money back. They say when they get thier money, I will be reinbursed. I tried contacting the prosecutor today, to no avail. will try again tomorrow. Road Rage charges sounds like what the SOB deserves.

It is the general practice of insurance carriers to have you pay your deductible no matter who's fault it was. Then IF they can collect from the other guy personally (good luck there) or through his insurance (a better chance) THEN they will give their client the deductible back. Basically it is their way of not being out money even when we are not at fault....just in case of a twist and it turns out it is our fault....or they can't collect from the party at fault for any reason.

It sucks, but it is generally how it is handled in the insurance biz. Not like we all have a few hundred sitting around in case someone hits us kinda thing....

The other option would be to have only filed with HIS insurance. Let them do their "investigation" and then when they accept fault they will pay the other party outright....not necessarily directly to a shop. But it sounds like lawyers might get involved in this one...so going through his insurance was a good idea....

REDBEARD...YOUR insurance company doesn't always have your best interest in mind as far as a settlement....I would do a free consult with a lawyer before accepting any offer based on this guys short fuse....

that's great news that there isn't any damage to the frame and that your insurance is going to fix it and pay you back after they sue that sob - hopefully he gets a lot of jail time

Brian - that would be funny and we should have all our Scions lined up in 2 rows so that he has to be escorted down the center of all our cars ha ha

don't cash a check either, if its for the car give it to the bodyshop as it maybe more than estimated. As for personal injury etc., once you cash that check, payment has been recived as far as the insurance co. is concerned and they are through.

lol umm that is thinking way to much. doubt this guy will learn. i mean one thing to lay on the horn and swear at someone inside our cars daily. but a person that acted out like that. will probably never learn
